Merritt, NC 28556 is hereby permitted to operate Septage Detention and Treatment Facility with permit # SDTF-69-03 located on SR 1328 in Pamlico County at approximate position 35.09685° N latitude and -76.60589° E longitude. This site is permitted only for operations that are conducted in accordance with the representations made in the approved application, with all conditions attached to this permit, and with all of the provisions of 15A NCAC 13B.0800 -- Septage Management. Failure to operate as permitted may result in the Department suspending or revoking this permit, initiating action to enjoin the unpermitted operation, imposing administrative penalties, or invoking any other remedy as provided in Chapter 130A, Article 1, Part 2 of the North Carolina General Statutes. This facility is subject to periodic inspection, as deemed necessary by the Division of Waste Management, to determine if the facility is in compliance with this permit. This permit is subject to review at least annually, or more often if deemed necessary by the Division of Waste Management, to determine if the operations permitted are consistent with the Septage Management Rules in effect at the time of the review. This facility shall be maintained and operated in a manner that will protect the assigned water quality standards of both surface and ground waters. Any flow of waste from the storage tank, underground pipe, or pump to adjacent surface waters shall be considered a violation of the NC Septage Management Rules. 2. Leaks and spills are the responsibility of the Permittee and shall be immediately contained, cleaned up, and treated to prevent any contamination of the surrounding area. Any solids from leaks or spills shall be disposed of in a manner consistent with the NC Solid Waste Management Rules. 3. The Permittee shall notify the Division of Waste Management at 919-707-8200 as soon as possible, but within twenty-four (24) hours of first knowledge, of the occurrence of any leaks or spill events that contact surface waters. For reporting any emergency after normal business hours, contact the Division of Emergency Management at 1-800-858-0368. 4. The method for controlling odors described in the approved application for this permit must effectively control all odors created by the operation of this facility as required by 15A NCAC 13B .0838 (g). 5. Erosion and runoff control measures shall be implemented to prevent migration of soil or wastes off this facility. The installation of groundwater monitoring wells or a leak detection system may be required at the discretion of the Division of Waste Management. 6. This permit shall not affect the applicability of any statutes, rules, regulations, or ordinances that may be imposed by other local, state, or federal government agencies that may have jurisdiction over this facility. 7. This permit may be modified or reissued at any time to incorporate any conditions, limitations, and/or monitoring requirements the Division deems necessary to adequately protect the environment and public health. This facility consists of one below grade 1,200 gallons concrete tank for the storage of domestic septage discharged from recreational vehicles that are not being used as permanent residences. Storage or treatment of any liquid or solid wastes other than those specified in the approved application for this permit is prohibited. 9. This facility shall only be operated under the supervision of Paradise Cove Marina staff. The Division shall be notified of any changes to this facility or its’ operation prior to implementation. 10. Only a Septage Management Firm permitted by the Division is authorized to pump septage from this detention facility. 11. This permit shall expire on September 29, 2025. Renewal or modification of this permit shall be in accordance with 15A NCAC 13B .0837 (i), (m), (n), or (q). An application for permit renewal shall be submitted at least ninety (90) days prior to the permit renewal date. 12. Records shall be maintained in accordance with the Septage Management Rules. These records shall be made available to a representative of the Division upon request. 13. Any duly authorized officer, employee, or representative of the Division may, upon presentation of credentials, enter and inspect any property, premises, or place on or related to the facility, at any reasonable time for the purpose of determining compliance with this permit; may inspect or copy any records that must be kept under the conditions of this permit; or may obtain samples of groundwater, surface water, or leachate. 14. I am sending you this email to let you know that the Permit, SDTF‐69‐ 03, covering the below grade 1,200‐gallon concrete tank for the storage of domestic septage discharged from recreational vehicles facility expired onMarch 30, 2020. This permit is different from the Permit to Operate a Septage Management Facility, Permit # NCS‐01262, issued on March 2, 2020. A notification for permit renewal should have gone out 4 months before the permit expired however, one was never sent to you. I have attached a notification letter that covers the information that needs to be submitted, an application for permit renewal, landowner authorization just in case you are not the sole owner of the property that the tank is own, and a copy of the previous permit. The previous permit also has the application that was last submitted. This may help you fill out the application. Please get this information to me as soon as possible.
