HomeMy WebLinkAbout22042 Matheson Ave Soil Export 2021.04.02 April 2, 2021 Sent Via Email Mr. Dan Fitzpatrick BP NODA, LLC and BP Trail, LLC 3328 Peachtree Rd, NE, Suite 100 Atlanta, GA 30032 dfitzpatrick@brandproperties.com Subject: Brownfields Soil Management Options Matheson Ave Brownfields Properties Charlotte, Mecklenburg County Brownfields Project Number: 22042-18-060 and 23015-19-060 Dear Mr. Fitzpatrick: The North Carolina Department of Environmental Quality (DEQ) Brownfields Program received and reviewed a request to export an approximate 1,500 cubic yards of soils from Matheson Ave II (22042-18-060) and Matheson Ave Creek (23015-19-060) (collectively, Matheson Ave) Brownfields Properties. This request was submitted on your behalf by Mr. Eric Wysong of Apex Engineering, LLC (Apex). DEQ understands the redevelopment on the Matheson Ave Brownfields Properties will be done jointly under the DEQ-approved Environmental Management Plan (EMP) dated November 26, 2019. DEQ Brownfields reviewed the soil analytical data provided in the Brownfields Export Soil Assessment Report dated April 1, 2021 prepared by Apex. Based on our review of the data provided, the DEQ Brownfield Program agrees that these soils may be exported to the following options: Reeve’s Landfill (2323 Salome Church Road, Charlotte, Mecklenburg County, Permit No. 60-S-LCID), or a Construction & Demolition (C&D) Landfill, or a Municipal Solid Waste (MSW) Landfill, or at another Brownfields Property with prior DEQ Brownfields approval. Other options may be available; however, DEQ requires that the receiving facility be identified and approved prior to export. The receiving facility should have metals concentrations which are consistent with those from the Brownfields Property. Matheson Ave April 2, 2021 Page 2 All soil export must be conducted under the DEQ Brownfields approved EMP. Per the Matheson Ave EMP, the soils will be field screened during excavation prior to export from the property. If unanticipated impacts are identified during excavation, please refer to the EMP for further actions and cease transfer until appropriate characterization can be completed. In addition, in accordance with the approved EMP, annual Redevelopment Summary Reports will be submitted to DEQ Brownfields. Details related to the disposition of this soil including but not limited to, total volume, general description of field screening efforts, etc. should be included with each Property’s Redevelopment Summary Report. Please be advised that this approval does not waive any applicable requirement to obtain any necessary permits, licenses or certifications which may be required from other state or local entities.
