15A NCAC 13B .0566 (8), "Surface water shall be diverted from the working face and shall not be impounded over
waste."
During this inspection, large vehicle ruts were observed throughout the top of the landfill. The heavy equipment ruts were
identified to be holding water. The area directly to the south of the entrance, appeared to have been scraped by a bulldozer
and was identified to be holding water. The areas holding water need to be properly graded to shed water from the surface
of the landfill.
15A NCAC 13B .0200 (g), "Disposal area boundaries for landfills permitted in accordance with Sections .0500 or
.1600 of this Subchapter shall be delineated with stationary markers affixed to the ground. The markers shall be of
height and spacing so that they are distinguishable from the surrounding landscape, and so that the adjacent markers
are visible when standing at a marker." and March 23, 2015 Permit to Operate, Attachment 3, Part I (2), "The edge
of waste footprint for all disposal units must be identified with permanent markers.
Orange traffic barrels currently serve as the edge of waste (EOW) markers. The barrels are not properly affixed to the ground
and can easily be moved or damaged. This item was noted in the June 8, 2016, June 27, 2017, and August 7, 2020 inspection
reports. Permanent edge of waste markers must be installed around the disposal area so that they are visible from
one to the next.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
