OBSERVED VIOLATIONS:
1. 15A North Carolina Administrative Code 13B .0841(e)(1) states: “Each detention and treatment facility shall be designed, constructed, and maintained in such a manner as to prevent leaks or the flow of septage out of the
facility into the seasonally high water table, onto the ground surface, or into any surface waters.”
Environmental Relief Technology, Inc. was in violation of 15A North Carolina Administrative Code 13B
.0841(e)(1) because leachate was allowed to flow uncontrolled into a storm drain for an approximate duration of 5 minutes.

ADDITIONAL COMMENTS
1. The septage treatment facility consists of one 225-gallon tank and three 5,300-gallon tanks for an approximate total capacity of 16,125 gallons for the storage of treated and untreated septage. Also observed were two
dewatering boxes and a final processing box.
2. The storage or treatment of any other liquid or solid waste other than grease septage is prohibited.
3. Wastewater from this facility is permitted to be discharged to the Archie Elledge WWTP. Solids from the treatment process are permitted to be disposed at the Haynes Mill Road Landfill (Solid Waste Permit 34-02),
Winston-Salem, Forsyth County, NC. Solid waste material is also disposed at the Wallace Farms composting facility.
4. “No Trespassing” signs were posted on the exterior of the building at the time of inspection. 5. No objectionable odors were observed outside of the facility.
6. Soon after arrival at the facility at approximately 1:30 PM, leachate from a dewatering waste began flowing
outside of the front of the building into a storm drain. The operator immediately began work to stop the
spillage. The spillage occurred for several minutes. The operator used a hose to wash the leachate that was inside the building back into the grate which connects to the floor sump. The material that was outside of the
building was washed into the storm drain.
The City of Winston-Salam Stormwater/Environmental Control staff were contacted by Mr. Harrison with the
assistance of Jason Watkins, Solid Waste Section, Field Operations Branch Head. Mr. John Spainhour and Mr.
Ladonta “Jamal” Clark arrived on site with Mr. Harrison to continue the investigation. On August 7, 2018, it was confirmed that the drain in front of the facility located at 617 Waughtown Street and operated by
Environmental Relief Technology, Inc. is a storm drain. The permit application for the current permit was submitted on February 25, 2017 and contained the following
procedures of how leaks or spills are controlled: “All processing takes place inside the facility. There are floor sumps in each portion to capture leaks/spills. All spills are captured and re-processed as there is no access to sanitary sewer from the floor sumps.” In addition, the Permitting and Operations Manuel Item 9 for the facility
states: “Spill Prevention – In the event of a leak or ruptured tank, operator will utilize the list of accepted haulers for clean-up.” These procedures are inadequate and must be revised.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

7. Solid Waste Section records indicate that a Notice of Violation was issued on July 19, 2012 for “septage residue” leaking from a 20-yard roll-off container into a nearby storm drain.
