The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
On March 24, 2021, Chuck Kirchner met with Dillon Dispennette to conduct a comprehensive inspection of the Town of Carrboro YWN off Public Works Drive in Carrboro, Orange County.
1. The yard waste notification (YWN) is located on a parcel of land owned by the Town of Carrboro.
2. The area used for the YWN is less than 2 acres.
3. Yard Waste Notification facilities (or sites) are small composting and/or mulching operations designed to repurpose yard waste into a soil addition or beneficial landscaping material. These small-scale facilities can operate without the need for a full permit from the Division of Waste Management. While there is no permit required for operation, the DWM does require that a notification form
detailing facility operations be submitted prior to beginning operations and annually thereafter.
4. The YWN site is not open to the public. Most yard waste on site is associated with the Town of Carrboro leaf collection. 5. Facilities operating under notification shall only receive: a. Untreated and unpainted wood waste.
b. “Silviculture Waste” as defined in 15A NCAC 13B .0101(41); waste materials produced from
the care and cultivation of forest trees, including bark and woodchips. c. “Yard Trash” as defined in 15A NCAC 13B .0101(55); solid waste resulting from landscaping and yard maintenance such as brush, grass, tree limbs, and similar vegetative material. d. “Yard Waste” as defined in 15A NCAC 13B .0101(56); yard trash and land clearing debris to
include stumps, limbs, leaves, grass, and untreated wood.
6. Facilities operating under notification are required to operate in accordance with 15 NCAC 13B .1406 and .1404(a)(1)-(10). 7. Material onsite shall be kept in manageable windrows. No material should be landfilled on site. If you desire to landfill material on site please contact the Solid Waste Section for assistance.
8. Windrow dimension should not exceed a height of 12’and a width of 20’. Minimum dimensions of 6’
high and 9’ in width).
9. Mr. Dispennette stated that the leaf mulch material is composted and redistributed to the public. Last year most compost went to a single farm in the area.
10. Ensure processed and unprocessed material on site is less than 6000 cubic yards quarterly.
11. The facility maintains records of the amount of leaves received. Records were verified from the
annual report for 2017-2018 ~ 5,700 yd3, 2018-2019 ~ 5,000 yd3, and 2019-2020 (to date) ~ 2,100 yd3.
12. The facility maintains temperature records. Temperature records were verified for 2020.
13. Temperature records shall be maintained at or above 55 degrees Celsius/131 degrees Fahrenheit for
three consecutive days prior to releasing any composted material to the public.
14. At the time of the inspection there was only one windrow of material on site. The front end of the pile had not yet reached adequate temperatures to be released to the public. Ensure temperatures are verified for the entire windrow as discussed at the facility.
15. Records should be maintained of the amount of LCD accepted. 16. Open burning of waste is prohibited. 17. Fires shall be reported to the Division orally within 24 hours of the incident and in writing within 15 days of the incident. 18. Adequate fire lanes are maintained around the compost windrow.

19. The Carrboro Fire-Rescue Department can be contacted to address an emergency at the facility.
20. Access roads are of all-weather construction.
21. The facility access is secured by a locked gate.
22. The facility sign should include YWN-68-002 and include emergency contact information.
