The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. Section staff met onsite to inspect NLCID and to introduce themselves to facility staff.
2. Inspector met with owner/operator onsite John Pandure. Mr. Pandure walked site with Mr. Powell and showed edge of waste (EOW). Area has an old silt fence put up with T posts around the outside of EOW. Fence is down in some areas. Based on onsite conversations of property line locations with Mr. Pandure waste seems to be
inside of buffer area and still within the 2-acre notification. However, there are not any corner markers for EOW to show the 2-acre notification exactly. Mr. Pandure is requested to install some larger corner marks to show the 2-acre notification and where waste had been covered. Suggest large PVC pipe in air several feet.
3. A small amount of digging was being done recently in open area, possibly in foot print of NLCIDLF. Be sure when disposing of waste that it isn’t in water or excavate too far and get into water table.
4. Waste has been pushed over edge, like a cliff, on the east side of notification. This, and all waste should be covered 30 days from disposal or when working face reaches half acre in size. Waste also needs to be pulled back away from edges of the notification to ensure doesn’t become larger than the 2 acre approved area and to allow for proper covering and sloping the soil while still being inside that 2-acre area.

5. Waste was observed over in corner of open area of notification that needed covering as well. Be sure waste is inside 2 acre approved notification footprint.

6. Onsite discussions included issues mentioned in this inspection report and Mr. Pandure indicated he could fix all of them within the 45 days’ time frame. Inspector will need to revisit to confirm corrective actions done. Any unapproved waste discovered while moving waste around should be properly disposed of at the landfill for that waste type.
7. Inspector sent Mr. Pandure new NLICD rules (.0563 - .0567) via email on 3/5/2021. Please read and review to ensure this facility becomes compliant with these rules moving forward. Onsite discussions also included the probably of selling this NLCIDLF and what that would mean for next owner. These notifications cannot be transferred and normally could be redone in new owner’s name. However, with new rules eliminating NLCID’s in 5 years, must become permitted or close down, the only way to continue operating would be to get this site permitted. That’s of course if it meets certain buffers, requirements etc. Ming Chao is the permitting engineer

owne r of the NLCIDLF after the 5-year period, if not permitted, will need to follow Closure and Post Closure Care rules .0567.
8. Corrective measures are necessary as result of this inspection. A follow up compliance inspection will be conducted by Solid Waste Section Staff in about 45 days (around April 20) from date of inspection. Failure to meet the conditions for compliance may result in Compliance Actions.
