We are currently in a lease to purchase contract. Purchase shall take place prior to final permit application. Section 2.) Siting Requirements 1. Site Location: Located in Rocky Point of Pender County, North Carolina. Closest towns are Hampstead to the East, Burgaw to and St. Helena to the North, and Castle Hayne to the South. The nearest city is the City of Wilmington located within 20 miles of the site location. 1 Compost Permit Application — Wilmington Compost Company Compost Facility at Piney Run Farm This site was previously managed by Clyde Wisecarver, owner of CN Farms operating as Running Deer LCID Landfill. The LCID Landfill permit allowed the acceptance of land clearing and inert debris, including the items listed below: a. Vegetative Debris b. Topsoil c. Concrete This site was also permitted to serve as a Temporary FEMA Relief Site accepting vegetative debris. See Appendix B for Running Deer Landfill Map with marked boundaries. 2. For a map showing the property parcel boundaries and parcel I.D. information, please see Appendix C. 3. Property Acreage: 73.2 acres a. Acreage of Compost Operation: 2-5 acres 4. Legal description of the property and land deed: a. In position of Clyde Wisecarver while WCC is in lease to purchase contract. 5. USGS Topographic Quadrangle Map of Site Area: See Appendix D 6. Reference Pender County Zoning approval and letter. a. Do not have at this juncture. 7. FEMA Flood Insurance Flood Plains Map: See Appendix E a. In Accordance with Rule .1404(A)(1): Site is not located in flood plain, therefore it shall not restrict the flow of the 100-year flood, reduce the temporary storage capacity of the floodplain, or result in washout of solid waste, so as to pose a hazard to human life, wildlife, land, or water resources. 8. Army Corps of Engineers Wetlands Letter: See Appendix F (not included) a. Still waiting on response from Army Corps. 9. In Accordance with the Compost Rules Sections .1404(A)(2) through (5), and (8): a. A minimum 100' buffer will be maintained between all property lines and compost areas as regulated in Rule .1404(A)(2). b. A minimum 500' buffer shall be maintained between compost areas and residences, or dwellings not owned and occupied by the permit applicant, as regulated in Rule .1404(A)(3). c. A minimum 100' buffer shall be maintained between all wells and compost areas, as regulated by Rule .1404(A)(4). i. There is only one well on -site used as a monitoring well. d. A minimum 50' buffer will be maintained between perennial streams, rivers, and compost areas as regulated by Rule .1404(A)(5). Please note, this site location does not contain or release water into any perennial streams and/or rivers. e. A minimum 25' buffer will be maintained between compost areas and swales/berms, as regulated by Rule .1404(A)(8). f. Distance to: 2 Compost Permit Application — Wilmington Compost Company Compost Facility at Piney Run Farm i. Nearest Offsite Residence: The nearest residence is located approximately 1,077' from the compost area. ii. Nearest Perennial Stream or Waterbody: The nearest perennial stream or waterbody is approximately 1.6 miles away from the front gates of the location. This waterbody is the North Cape Fear River. 10. No portions of the compost area are located over a closed -out and/or capped disposal area. 11. Soil evaluation on site conducted by a soil scientist down to a depth of 4', or to bedrock or evidence of a seasonal highwater table, to evaluate all chemical and physical soil properties and depth of the seasonal highwater table. Please See Appendix I. Section 3.) Design Plan: 1. The following types of feedstocks, residuals, bulking materials, and amendments are to be accepted: a. Pre and Post Consumer Food Waste — Collected from local commercial and residential sectors. b. Agricultural Waste — Collected from local farm and agricultural operations. i. Manure ii. Spent Produce / Field waste iii. Hemp Bio-Waste iv. Mushroom Substrate Material c. Yard Waste — Collected from commercial and residential sectors. d. Land Clearing Debris — Collected from commercial and residential sectors. e. Spent Brewery Trub/Grains — Collected from local breweries. f. Seafood — Collected from local seafood outlets, markets, and fishermen. g. Compostable Packaging Products — Collected from local commercial and residential sectors. All products must meet regulatory standards as set forth by the Biodegradable Product Institute, meeting standards ASTM D6400. 2. Total Estimated Amount of Materials to be Received Monthly: a. An estimated nearly 5,000 tons a month in feedstocks, residuals, bulking materials, and amendments are projected to be received at the facility (in tons). i. Pre and Post Consumer Food Waste Monthly: 250 ii. Agricultural Waste: 250 iii. Yard Waste: 2,000 iv. Land Clearing Debris: 2,000 v. Spent Brewery Trub/Grains: 100 vi. Seafood: 250 vii. Compostable Packaging Products: 60 3 Compost Permit Application — Wilmington Compost Company Compost Facility at Piney Run Farm b. Seasonal Variation: There should be minimal seasonal variation besides an expected increase in yard waste and land clearing debris during heightened storm seasons. 3. Design Capacity of the Facility: a. Annually, an estimated 60,000 tons of materials are expected to be collected, received, and processed. b. Calculations: 5,000 tons a month x 12 months = 60,000 tons annually 4. Site Areas: a. Feedstocks: 1-2 acres b. Storage: 1 /2 acre in sheds/covered structures (pole barn) c. Composting: 1-2 acres d. Finished Compost: 1/4 acre 5. Recipe: a. Utilizing the Green Mountains Technologies compost recipe calculator, approximately 800 Ibs of carbon wood waste mixed with approximately 500 Ibs of nitrogen food/produce waste will produce the proper density, moisture content, and (C:N) ratio. Overall, we will maintain a C:N ratio of 30:1. b. Moisture Content: 40%-60% 6. Methods used for Measuring, Shredding, Mixing, and Proportioning Feedstock Materials: a. All measuring, mixing, and proportioning will be done by a front-end wheel loader utilizing specific bucket sizes and or scales. b. Shredding will take place onsite with a grinder and/or chipper. 7. Site Flow Chart: a. See Appendix G 8. Process Durations: a. Receiving: Daily b. Preparation/Mixing: Daily c. Composting and Curing: i. Composting: 4-6 Months ii. Curing: 30 Days d. Distribution: Upon the completion of curing. 9. Compost Method —Windrows a. Method for time and temperature monitoring. i. Time — Windrow duration will be monitored and tracked daily. ii. Temperature — Daily temperature reading will be taken using a 36" (3ft) thermometer and all readings will be logged on file. 10. Surface water control features are natural bioswales, with native vegetative growth to act as a filtration system. Grading will be maintained at a sufficient slope so that no puddling of water occurs. Operational plans in wet weather shall remain normal unless there is an electrical storm or a disturbance in ground structure. 0 Compost Permit Application — Wilmington Compost Company Compost Facility at Piney Run Farm 11. Process water or contact water will be retained in a buffer system to be reutilized/pumped back into the compost operation. All time and temperature requirements to reduce pathogens will begin again. 12. Amendments: At this point in our compost process, we do not add any additional amendments such as the following: lime, wood ash, gypsum, etc. 13. Description of Controls: a. We spray water to maintain dust control on roadways, windrows, and operational areas. b. Cover windrows with wood chips and/or finished compost. 14. Description of Recycling or Other Materials: a. Description of equipment, scales, structures, unloading areas, water sources, etc.: a. Equipment: i. 2 Wheel Loaders — Bucket scales on wheel loader buckets ii. Box truck — 16' Box truck used for hauling service iii. Pickup truck — General use iv. Dump Truck — 16' dump truck v. Horizontal Grinder — grinder/chipper for wood waste recycling vi. Screener — 36 yrds/hr used for screening processed/finished materials b. Equipment maintenance: equipment will be monitored and maintained in operating status. C. Structures: i. Office — Used to monitor and coordinate drop-offs and pick-ups, as well keep record ii. Storage structures — utilized for storing equipment/tools d. Unloading areas: i. All unloading zones will occur in marked areas e. Water Sources: i. Ponds — onsite there are 6 ponds. Each dug out to a depth of 2- 14ft. 1. 4 ponds are located in the front of property and 2 are located in the rear of property. 5 Compost Permit Application — Wilmington Compost Company Compost Facility at Piney Run Farm ii. Drainage ditch — There is a man-made drainage system constructed around the property's border that lead to the back settlement pond. 3. Site Security and Access Control: a. The site is secured with a locked gate system 24/7 except during operational hours. b. "No Trespassing" signs are visible at entrance to property. c. A camera system is in place. d. Yes, this site will receive feedstock residuals from the general public. 4. Yes, an operator will be on duty during operational hours to ensure compliance with operational requirements. 5. All access roads and internal road systems are of all-weather construction and will be maintained in good condition. 6. Operational Schedule: (Subject to change) a. Days: Monday — Friday b. Times: 7am-5pm c. Preparations for opening: i. Opening the gate/site ii. Site/equipment inspection d. Preparation for closing: i. Park/Store all equipment away in designated storage areas on site ii. Check on site/equipment iii. Lock the gate/site 7. A sign will be posted and maintained that includes the type of waste that can be received, the type of waste that is prohibited, the operational hours, permit number, and emergency contact phone numbers of the main operators and staff. The sign will also include that no hazardous waste, asbestos containing waste, or medical waste will be accepted at this site. 8. Boundary markers will be maintained and kept to clearly allow for a line of site from one marker to the next. All boundary markers will be marked to identify buffers and setbacks. These markers consist of white PVC piping with orange tips, along with tree's acting as markers clearly labeled with orange paint. a. These markers are at a distance <50' from one to the next. 9. List of personnel and responsibilities: a. Riley Alber: owner and operator b. Trey Alber: owner and operator c. Mary Alber: owner and controller 10. All personnel requirements described in Rule .1406 (19)(a)(b) will be met and maintained and listed out in the permit. 11. Narrative description of compost process: a. Arrival of materials: WCC trucks will offload food waste into designated food waste drop zone. N Compost Permit Application — Wilmington Compost Company Compost Facility at Piney Run Farm i. Vegetative wood waste /land clear debris: dropped off by WCC and residential/commercial sectors around the community in marked zones b. Unloading: All unloading will take place in clearly marked zones c. Processing: All feed stocks will be monitored and processed prior to mixing. d. Mixing: Mixing of feedstock materials will take place on a pad with the wheel loaders. e. Storage: i. Windrows will be maintained in their proper shapes ii. Feedstocks will be stored as needed f. Composting: will take place in windrows with a duration of 4-6 months g. Curing: curing will take place for 30 days during the "composting" stage h. Testing: each batch will be tested through the United States Compost Council STA Program. i. Final Product Storage: will be stored on separate curing pad j. Removal from site: products will be moved through wholesale and retail outlets in trucks, trailers, and/or bags. 12. Screening unacceptable waste: a. All incoming loads will be monitored for contamination by on -site personnel b. All unacceptable waste will be removed and discarded in appropriate receptacle containers c. Containers will be removed off -site as need to properly manage the waste volume/flow 13. Special Feedstock or Residual Handling: a. No special handling should take place on site 14. No amendments will be added to the compost. If this occurs, we will have amendments tested to meet all requirements. 15. Preparing Materials: a. Grinding will take place with all vegetative waste to create "mulch/woodchips" to be utilized in the compost b. Mixing of Carbon and Nitrogen materials will take place in preparation for windrows 16. Pile sizes: a. Feedstocks - pile sizes will reflect permitted regulations b. Composting — windrows will meet all size requirements and dimension c. Curing — all cured piles will meet all size requirements d. Final Products — all piles of finished products will not exceed 50' wide and 30' in height 17. Time, Temperatures, and Turning Requirements: a. Time: all time requirements will be met as listed in Rule .1406 (12)(13) b. Temperature: requirements will be met as listed in Rule .1406(12)(13) 7 Compost Permit Application — Wilmington Compost Company Compost Facility at Piney Run Farm i. Thermometer probes — 36"length (3ft) ii. Reading — multiple readings will be taken per pile at a distance of approximately 5 feet from one another c. Turning: requirements will be met as listed in Rule .1406 (12)(13) 18. Probe Thermometer: a. Type: General Thermometer b. Size: 36" or 3' c. Calibration method: Ice water once a year i. records will be kept of date/process of calibration 19. Other Monitoring: a. Monitoring will take place during our testing program (feed stocks, finished products) b. Moisture will be monitored throughout the entire process to maintain 40%-60% moisture content. 20. Method of Aeration: a. Aeration will occur through turning/mixing of the windrows b. Frequency: turning will take place at a rate to meet all VAR and PFRP requirements simultaneously 21. Compost testing and method for collecting samples shall be in accordance with Rule .1407(b)(1-6) a. The pathogens samples should be collected as a composite sample from finished compost on -site on the same day it is to be taken to the lab for analysis. The sample should be processed within the hold time required by the lab testing procedure and this is usually 24 hrs. b. The sample that is collected for metals analysis is to be collected and composited over a 6-month period or every 20,000 tons produced from each batch of the compost. 22. Distribution and Use of Finished Compost: a. Distribution and Use: both wholesale and retail markets will be targeted b. All nutrient claims will meet the requirements of the NC Department of Agriculture and Consumer Services, Plant Industry Division. 23. Residues and Finished compost that cannot be used: a. Residues and finished compost that cannot be used will be stored onsite to be recycled back into the beginning of the composting process. 24. Record Keeping and Annual Reporting a. A copy of the permit, plans, and reports will always be maintained onsite in accordance to Rule .1406 (1)(B) b. Documentation of training requirements will be kept on -site and made readily available for any necessary party in accordance with Rule .1406 0 9)(C) c. Record keeping will be in accordance to Rule .1408 d. Logs/Forms will be kept on file Compost Permit Application — Wilmington Compost Company Compost Facility at Piney Run Farm 25. Surface water is controlled and maintained by a drainage ditch system that surrounds the permitted area and flows into a sediment pond. There are also 5 other ponds located on site for water control. 26. Fire Protection Agency Paperwork: a. Pender County EMS and Fire- Appendix H (not included) i. Trying to reach right personnel. 27. Fire Prevention Plan: a. Plan outline: In the case of a fire the following steps will be taken: i. Identify Fire Location(s) ii. Check the safety of all personnel iii. Identify proper fire fighting equipment iv. Notify proper authorities v. Identify personnel tasks vi. Execute Fire Fighting plan b. Onsite Equipment: i. 160HP water pump system with 550' of 2" fire hose 1. Hose has been proactively tested to reach and deliver water to farthest points necessary from each pond ii. Ponds — 5 ponds as a water source for fire mitigation and fighting c. Any fire will be reported to the Solid Waste Section within 24 hours followed by a written notification of the details of the fire within 15 days of the incident. 28. Plan for Maintaining Facility Property: a. Property will be maintained in a sanitary condition b. Noise: Operate during operating hours only. Buffers, berms, and green space will be utilized to minimize noise exposure offsite. c. Vectors: All vectors will be minimized by Best Management Practices (BMP) onsite such as, buffers, tree -lines, tarps, etc. d. Litter: Will be monitored and maintained in proper disposal containers with a disposal rate that does not allow for excess waste to accumulate. e. Dust: Water will be sprayed on roadways when needed to maintain low dust levels. f. Airborne Particulates: tarps, buffers, screens, coverings, etc will be utilized when needed to minimize airborne particulates. g. At the end of each operating day the unloading area will be organized, feedstocks will be processed, mixed, or properly stored. 29. Contingency Plans: a. Wind: Properly manage, contain, and store feedstock and composting materials. i. Wind to this location: We typically see South Eastern winds in the summer months which would blow towards a 1,700 acre farm used for hunting, hog farming, and recreation, which is then backed up by Holly Shelter Game Lands. 9 Compost Permit Application — Wilmington Compost Company Compost Facility at Piney Run Farm ii. During the fall and winter months we see North East winds which blow in the direction of large timber tracks of over a mile and a half wide that butt against the Cape Fear River. On the other side of the river are continued tree stands. b. Rain: Operations should continue as normal until electrical storms occur or a disturbance to the ground begins (deep tire tracks) c. Snow: Operations will continue as normal until weather presents less than ideal conditions. d. Freezing weather: See answer above for "Snow" e. Extreme Weather Event: Store, lock down, and prepare the site before closing down operations. Resume when weather is safe to perform operations again. f. Air Pollution: Covers, BMP, and Buffers will be utilized to control and prevent air pollution. g. Equipment Breakdown: Equipment maintenance and repairs will take place as need. All repairs will be documented to keep a close record on equipment and state of working condition. h. Spills: Identify the source, take subsequent action to stop and remediate the problem. i. Unusual Traffic Patterns: Maintain open visibility, clear traffic lines, clear signage, and extra personnel when/where needed to help conduct efficient traffic flow. j. Long Term Power Outages: Maintain in contact with our energy provider, Duke Energy. 30. Site Safety: a. All personnel and onsite staff will be properly trained on equipment b. All personnel and onsite staff will be made aware of proper procedures in case of an injury, fire, or other hazard i. Yearly practice drills will be conducted and recorded to ensure all staff and personnel are prepared for such an event c. Signs will be properly utilized to address other site hazards to workers or the public 31. Closure of Site: a. All feedstock and unfinished compost materials will be removed from the site and taken to a permitted solid waste facility within 180 days b. Finished compost materials left onsite shall comply with GS 130A- 309.05 c. The owner or operator will notify the Division in writing upon completion of the requirements if the permit shall be terminated. d. Future composting operations at the site shall require submittal of a new permit application in accordance with Rule .1405 of this Section. 10 Compost Permit Application — Wilmington Compost Company Compost Facility at Piney Run Farm Section 5.) Odor Control Plan - Site Specific 1. Identification of all onsite potential odors on map: See Appendix 1 2. Onsite weather condition: a. Wind Conditions: All wind directions blow into large wooded parcels surrounding the site. i. Summer Season (May — August): We see primarily South East winds. This carries any odors in the direction of the Mclean Family Farm, LLC which is 1,600 Acre parcel used for recreation and hunting. There is also a 700 acre parcel on the Northeast quadrant of the 1,600 that is a hog operation. Backing this land up is Holly Shelter Game Land owned by the Nature Conservancy. This is a 64,743 acre land tract. ii. Fall / Winter Seasons: We see primarily North East winds during this time of the year. This wind direction carries any odors in the direction of another 1,200 acre Mclean Family Farm, LLC parcel that is then surrounded by wooded timber land all the way until the Cape Fear River which is 1.5 miles to the South. b. Topography: the topography of the site will not affect odors on site. c. Seasonal Variations: During seasons with heightened storm activity and higher wind periods, covers and buffers will be utilized and properly vegetated to capture odors onsite. 3. Onsite monitoring and record keeping of odor data will be kept at all time for odor sources with the potential to migrate offsite. Data will include, but shall not be limited, to date, time, site specific conditions, weather conditions, wind direction, characteristics, and intensity of odor. 4. Facility Odor Complaint Protocol: a. Odor Complaint Form — outlining complaint (who, what, where, when, why) b. Identify odor source onsite and offsite by operator c. Identify best course of action to mitigate odor d. Contact appropriate personnel i. Complainer ii. On site personnel iii. Hazardous Waste Responders — if odor is alarming 5. Complaint Record Keeping: a. Records of complaints will always be kept on file onsite b. Records will include: date, time, complainer information, and reason for complaint 6. Odor control and Best Management Practices Onsite: a. Feed stocks will be managed on a timely manner, mixed appropriately, and stored in a way to mitigate and eliminate odors c. Mixing: Mixing of materials is to take place in a timely manner upon receiving feed stocks to mitigate odors d. Handling incoming feedstock: appropriately separate, mix, and store feedstocks to mitigate odors e. Moisture: Monitor compost pile moisture levels by hand testing it. Maintain a 40%-60% moisture level. f. Aeration Methods, Frequencies, Protocols: i. Aerate by turning windrows with wheel loaders ii. Turn as needed based on temperature, time, moisture, and odors iii. Protocol — turn when needed, pay attention to the signs g. Leachate and Liquid Management: i. All leachate and liquids shall be monitored and captured in a way a health or contamination threat is not present onsite or offsite. Liquids/leachate should be recycled back into the composting process. h. Weather Monitoring and Protocol: i. A daily weather check should take place in the morning before operating hours begin ii. Operate onsite in accordance to weather protocols i. Airborne Emissions: i. Feedstocks and materials should be managed in a way to eliminate potential airborne emissions j. Windrow Covering: i. OCTOBER 2016 TABLE OF CONTENTS 1.0 GENERAL INFORMATION 2.0 OPERATION AND DEVELOPMENT OF LANDFILL 3.0 VEGETATION PLAN Operational Plan Running Deer L&D Landfill October 2016 1.0 General Information This Operational Plan is an update to the original Operational Plan designed to carry out the necessary proceedures for proper useage of the Running Deer Land Clearing Inert Debris Landfill to be located in Pender County East of interstate 40 along State Highway 210. The property on which the Landfill is located is owned by the applicant. The applicant's remaining portion of the 68 acres of this tract of property is used for hunting game and some pasture land. The owner currently operates a 27 acre Land Clearing Inert Debris landfill on the northwestern corner of the property and the previously permitted 10 acre mining operation is now closed. This update is due to change in ownership to Clyde Wisecarver. The applicant proposes to continue operating in Cells "B", "C", and a proposed new cell "E". The proposed cell "E" was formerly the site of an Air Curtain burner to dispose of high volumes of storm debris. This property has reverted back to Clyde Wisecarver and is suitable for a new cell of LCID. Approximately 314 of the property is wooded with access roads and drainage ditches crossing the site. The existing ditches run to the northeastern corner of the property where an existing sedimentation pond is located. The effluent of the pond flows into Trumpeter Swamp. The sedimentation pond was doubled approximately year 2000 to accomodate the work at the landfill. Six small ponds currently exist on the site which were created by mining in the late 1980's. An existing entrance road and haul road which previously were used for logging will be used as the haul road for the mining operation. This road is well developed and built out of gravel. Land use in the vicinity contains residential owners along with logging operations and also a hog farm. Five mobile homes are located along NC 210 just south of the entrance but at least 500 feet from any proposed landfill operations. The total permitted landfill area is 32.0 total acres which also includes buffer zones. Grading in the buffer zones will be held to a minimum to reduce sediment erosion. Typical averages at the site have been approximately 25,000 cubic yards per year. It is estimated that there is approximately 75,000 cubic yards of availability in the expanded section of "B" and the new section "E" of the landfill area which would accommodate the average instream for over 3 years. Disturbance will follow the construction schedule and reclamation will be conducted as appropriate landfill areas are completed. Operational Plan Running Deer LCID Landfill October 2016 2.0 Operation and Development of Landfill 1. Landfill owner and operator responsible for the Landfill facility will be: Clyde Wisecarver 6524 Murrayville Road Wilmington, NC 28411 (910) 619-4121 2. After completion of Landfill operations the land will be reclaimed as hunting and fishing areas in conjunction with ponds created by mining at the site. 3. The Running Deer LCID Landfill will only accept the following items for disposal: stumps, trees, limbs, brush, grass, other natural vegetative material, yard trash, untreated wood, unpainted wood, concrete, brick, uncontaminated soil, rock, and gravel. NO ASPHALT, USED ASPHALT, OR MATERIALS MIXED WITH ASPHALT WILL BE ACCEPTED AT THE FACILITY. 4. Upon completion of filling Section "C then filling will continue out the South branch towards the expanded section "B°. Section "E" will be filled next. Completing Sections "B" and "E" is estimated to be within 3 years. 5. Adequate soil cover that is to be landfilled will be stockpiled in an unused Section for future use as cover material or beneficial fill. One foot of beneficial fill will be placed over existing ground surface to properly maintain waste/groundwater separation at the site. Cover material will be acquired from the Running Deer mine. Soil Cover will be applied monthly or when an active area reaches one acre in size. Daily Log will incorporate cover activities so that a record will be kept that ensures cover is placed monthly. Daily Log will also contain field measurements of the active area to ensure more than an acre of landfill active area is exposed. 6. At the completion of landfilling activities the disposal area will be covered with a minimum of one foot of soil cover. Revegetation plan will be followed at this point. Permanent erosion control measures to be implemented within 120 calendar days of any phase completion. All side slopes shall not exceed three to one (3:1) in accordance with 13B .0565(3)0). 7. The facility will maintain adequate security by having lockable gates at all entrances and maintaining vegetative buffers where possible. An attendant will be on duty at all times the landfill is open for public use to assure compliance with operational requirements and to prevent acceptance of unauthorized wastes. The Landfill Attendant will visually inspect the debris upon arrival and document location of where the load was placed. Once dropped, the Landfill Attendant will also visually inspect the debris on the ground for unacceptable materials. If unacceptable materials are found, they will be sorted out to a separate pile. The materials will then be properly disposed at a permitted landfill. A Daily Log will be maintained in the small "check -in" office located along the haul road just inside the main gate. Violators of unacceptable materials will be identified in the Daily Log. Operational Plan 3 Running Deer LCID Landfill October 2016 8. All existing haul roads will be inspected monthly and repaired as needed to maintain functionality at the site. 9. During landfill operations, slopes will be maintained so that surface waters are not impounded over waste. 10. There will be no excavation to facilitate landfilling. All wastes will be deposited over existing ground surfaces. 11. All large earthmoving equipment on site will be equiped with fire estinguishers in an event of fire. Small fires will be attempted to control by on -site personnel. Pender County Fire Squad will be notified when fire becomes uncontrollable. 12. To ensure the landfill waste disposal areas are not encroaching into either the required bouondary buffer setbacks and the adjacent wetland areas, the installation of durable and visible permanent markers will be employed for each section's waste boundaries. Construction Schedule Obtain plan approval and other applicable permits. 2. Hold pre -construction meeting at least one week prior to beginning construction. 3. Install/Maintain temporary construction entrance/exit. 4. Place inert benificial fill in existing ditch and have inspected prior to continuing fill operations. 5. Begin filling of permited area. 6. Where necessary, install silt fencing to reduce sedimentation into ditches or adjacent property. 7. When a 5 acre cell has been completely filled, begin permanent vegetative reclamation of disturbed areas. 8. All erosion and sediment control practices will be inspected bi-weekly and after rainfall events. Needed repairs will be made immediately. 9. After each fill area is stabilized, all temporary measures will be removed and permanent vegetative repairs to be completed. 3.0 Vegetative Plan 1. Upon completely filling a 1 acre cell, top cover soils will be roughened by making 1"- 2" deep grooves perpendicular to the slope. 2. The permit boundaries are located within proper setbacks and siting requirements described in NCAC 15A-1313.0564. Disturbance will follow the construction schedule and reclamation will be conducted as appropriate landfill areas are completed. Sediment Erosion Control Practices Temporary Gravel Construction Entrance/Exit -- Practice 6.06 A temporary gravel construction entrance will be installed at the northwestern gated entrance to prevent sediment from leaving the site. The entrance should be graded so that runoff water will be directed to the north onto owners property. See Construction Detail Sheet for dimensions and specifications. 2. Land Grading -- Practice 6.02 The existing slope of the site is mostly flat except for the current landfill areas where the elevations rise. All disturbed areas in and around the landfill will be rough graded to slope and drain into the existing ponds. Sediment will be directed to drain back into the ponds even after finish grading by constructing new ditches. Compost Rules are located in 15A NCAC 13B .1400 et seq., and can be viewed online on our compost webpage: http://deg.nc.gov/about/divisions/waste-management/solid-waste- section/composting. The completion of an application is required for the permitting or approval of all compost facilities, with a few exceptions. Permits are not required for backyard composting, certain farming operations, and certain small compost operations (see Rule .1402 (f) and (g)). If the majority (more than 50%) of the material to be composted, not including bulking material, is animal manure or wastewater treatment sludge, the permitting process is regulated through the Division of Water Resources (DWR), instead of the Solid Waste Section. Contact the Solid Waste Section for more information. For compost facilities that require a permit, there are three types of permit actions: A "new permit" means an application for a permit for a facility that has not been previously permitted by the Department. A significant expansion, change in the facility type, or change in the boundaries of a permitted facility may be considered a new permit. A "permit amendment" means (1) an application for the ten-year renewal of a permit for a permitted facility, or (2) an application that proposes a change in ownership or corporate structure of a permitted facility. A "permit modification" means an application for a change to the plans approved in a permit for a compost facility or the addition of new feedstock materials. One paper copy and one electronic (pdf) copy of the application report should be submitted. The electronic copy can be sent by email, on a CD, or by online file share. The drawings must be included in the electronic copy. Applications should be sent or brought to the following address: By Mail or Delivery Service: NC DEQ, Division of Waste Management Solid Waste Section 1646 Mail Service Center Raleigh, NC 27699-1646 In Person: NC DEQ, Division of Waste Management Solid Waste Section 217 West Jones St. Raleigh, NC 27603 An annual fee of $500 is required for large compost facilities, not for small facilities (see Rule .1402 (e)(6) and (7) for definition). An application for a new permit for a large facility is $50. This guidance is not a substitute for the applicant reviewing and understanding the applicable North Carolina Statutes and Administrative Code. For a new permit application or permit amendment/renewal application, a compliance history review will be required of the owner and operator of the facility, in accordance with State statutes. After the application is submitted, the owner and operator will be sent a letter requesting compliance history information, and parent, subsidiary, or other affiliate information, which is required in order to complete the application. Questions regarding an application should be directed to the Solid Waste Section, Phone 919-707- 8200. Please note that new compost operator training requirements became effective on November 1, 2019, for Large Type 2 and all Type 3 and Type 4 facilities. Compost facilities that were permitted before that date are required to meet the operator training requirement by no later than November 1, 2022. Operators of new sites permitted after November 1, 2019, are required to meet the rule within 18 months of permit issuance. See Rule .1406 (19) for more information. An application for a new permit must address all Sections as listed below. An application for a permit amendment (permit renewal) must address Sections 1, 3 (updated as necessary), 4, 5, 6, and other Sections as applicable (including drawings), in which any information contained in the original permit application is incomplete or has changed. A copy of the Site Plan drawing should be included with the application. An application for a permit modification must address Sections 1, 3, 4, 5, 6, and other Sections as applicable (including drawings), in which any information contained in the original permit application has or will change due to the proposed modification. Applications for a Large Type 3, Small Type 4, or Large Type 4 facility, or a facility proposed to be located over a closed -out disposal area, must be prepared and signed/sealed by a N.C. registered professional engineer. The name of the facility or proposed facility. Street address of the facility. Include the facility type: large or small, and Type 2, 3, or 4. 2. Name, address, telephone number, and email address of the applicant/owner and contact person. Name, address, telephone number, and email address of the landowner, if not the applicant. A landowner authorization form must be signed and notarized if the facility owner/operator is not the landowner (see attached form). 4. Name, address, telephone number, and email address of the engineer and/or composting consultant (if applicable). 5. Name, address, telephone number, and email address of person to receive permit fee invoices and annual fee invoices, if applicable. Section 2 — Siting Requirements — Provide a narrative discussion that includes the following items: 1. Location of the facility. Include the county location, and proximity to nearest town or city. If the property was previously used for solid waste management activities, provide a description of the operation including permit information and a map with boundaries. Describe the history of any solid waste permits and approvals issued. 2. Provide a map showing the property parcel boundaries and parcel ID information (this can usually be obtained from the County's GIS website). Describe any other commercial or industrial use of the property. 3. Total acreage of the property and the size of the actual compost operations area. The operations area includes unloading areas, mixing/processing areas, composting and curing areas, and feedstock storage areas. 4. In an appendix, provide a legal description of the property and a complete copy of the current land deed. Also, provide a copy of any available current plats or survey drawings of the property. Reference these items in the text of this section. 5. Provide a copy of the USGS topographic quadrangle map of the area. The property boundaries of the site and the approximate composting and storage areas should be drawn onto the map. The map may be a high quality color photocopy and should show at least 0.5 mile surrounding the property boundary. 6. In an appendix, provide a letter from the appropriate City or County official confirming that the siting of the facility will be in conformance with all zoning and local laws, regulations, and ordinances, or that no such zoning, laws, regulations, or ordinances are applicable. Reference the letter in the text of this section. 7. Provide a copy of the FEMA Flood Insurance floodplains map for the area, with the site property marked on the map (appendix or within the section). Discuss compliance with Rule .1404 (a)(1). 8. For sites that potentially contain wetlands, provide a letter from the Army Corps of Engineers that addresses the wetlands determination for the property, and compliance with requirements, if applicable. Include letter in an appendix and reference the letter in the text of the section. Discuss compliance with the buffer requirements of the Compost Rules, Section .1404 (a)(2) through (5), and (8). Buffer requirements apply to unloading areas, composting and curing areas, mixing/processing areas, and feedstock storage areas. Final product may be stored within the buffer. Provide distance from the compost boundary to the nearest offsite residence, and nearest perennial stream or water body. 10. Address compliance with Rule .1404 (a)(7), concerning sites located over a closed -out disposal area. 11. Address compliance with the soil texture requirements or pad requirements of Rule .1404 (a)(10)(B) through (D). For outdoor facilities, provide a soil evaluation of the site conducted by a soil scientist down to a depth of four feet, or to bedrock or evidence of a seasonal high water table, to evaluate all chemical and physical soil properties and depth of the seasonal high water table. Include the report in an appendix, and reference the report in the text of the Section. Section 3 - Design Plan — Provide a narrative discussion, broken into appropriate sections, that includes the following items: List the types of feedstocks, residuals, bulking materials, and amendments to be accepted (for example, yard waste, land clearing debris, pre -consumer food waste, post -consumer food waste, grease trap waste, agricultural waste, etc.). For each material, provide a description, list the sources, and indicate whether it will be accepted from the general public. Analytical data will be required for materials that could contain metals or other contaminants, such as commercial or industrial by-products. For Type 4 wastewater treatment plant sludge/biosolids, provide analytical analysis of total metals by SW-846 methods, for arsenic, cadmium, copper, lead, mercury, molybdenum, nickel, selenium, and zinc, for each waste source. Provide an estimate of the total amount of materials to be received at the facility per day, week, or month, in tons or cubic yards. Provide an approximate amount for each type of feedstock to be received, per day, week, or month. Describe any seasonal variation for any of the materials. Provide the design capacity of the facility, best estimate. The site capacity is the incoming volume, or throughput, per year, and is based on the compost method, duration of the process, and the size of the facility. Show calculations for Large Type 3 and 4 facilities. This is for information purposes only, not to be used as a limit. 4. Provide a description and sizing of the storage areas or containers for feedstocks, amendment, recyclables, finished compost, and waste. 5. Describe and provide compost recipes. a. For Type 2 operations, describe plan for balancing the carbon and nitrogen ratio ("browns" and "greens") b. For Type 3 and Type 4 operations, provide carbon to nitrogen ratio (C:N) testing and calculations. There are compost recipe calculators online that can assist with this, balancing density, moisture, and C:N ratio. 6. Describe methods used for measuring, shredding, mixing, and proportioning feedstock materials, to insure the proper ratios are met. 7. Provide a process flow diagram of the entire operation, including the type, size, and location of all major equipment, and feedstock flow streams. The flow streams should indicate the quantity of materials by weight and volume. Also include plans and specifications for the facility, including manufacturer's performance data for all equipment selected. 8. Provide the anticipated process duration for each stage of the process, including receiving, preparation, composting, curing, and distribution. 9. Describe the compost method (windrow, static aerated pile, in -vessel, etc.), and method for time and temperature monitoring. 10. For outdoor facilities, describe surface water control features, including run-on and run-off. Describe grading and sloping of site surface to prevent ponding of water. Describe plan for operation of the facility in wet weather. Surface water must be diverted from the operational, compost curing, and storage areas. For sites that will have run-off from the facility operation, a stormwater/wastewater permit will most likely be required (see page 2 for contact information). 11. Process water or contact water (water and liquid that has come in contact with compost or feedstocks) may either be collected and disposed of separately, or for some facilities, it may be approved for combining with clean surface water run-off for discharge from the site with a stormwater/wastewater permit. Describe the collection, storage, and disposal of process water. Disposal could involve connection with a sanitary sewer line, or collection in a holding tank, with the liquid periodically pumped and removed from the site for proper disposal. Process water may also be added back to the compost; however, time and temperature requirements to reduce pathogens must begin again, and the text should describe this. 12. Describe any amendments (lime, wood ash, gypsum, etc.) to be added to the finished compost, if applicable, including the amount. For wood ash, provide analytical data for total metals by methods in SW-846. Describe storage of the amendments, maximum pile size, and methods to prevent surface water run-on and run-off, if applicable. If wood ash is added, it should be stated that samples for required finished compost metals analysis will be taken from the compost after the ash is added. 13. Describe controls to address dust and other air emissions (example, a spray mist for dust). For indoor facilities, describe how particulates are minimized. 14. Describe any recycling or other material handling processes used at the facility. Section 4 - Operation Plan — Provide a narrative discussion, broken into appropriate sections, that includes the following items: 1. Name and contact information for the person responsible for the operation of the facility. 2. A list and description of the equipment, scales, structures, unloading area, water source, hopper, and any other feedstock or compost management devices. Also describe equipment maintenance. 3. Site security and access control. Large sites must be secured by gates, chains, berms, fences, or other measures to prevent unauthorized entry. Include whether the site will receive feedstocks or residuals from the general public. 4. Confirm that an operator will be on duty at the site at all times while the facility is open for public use to ensure compliance with operational requirements. Confirm that access roads will be of all-weather construction and maintained in good condition. 6. A schedule for operations, including days and hours of operation, preparations before opening, and procedures to be followed after closing for the day. 7. Signs to be posted at the entrance. Signs must provide a description of the types of wastes that may be received, the types of waste prohibited, operating hours, permit number, and emergency contact phone numbers. The sign should state that no hazardous waste, asbestos containing waste, or medical waste can be received at the site. 8. Permanent boundary markers may be required, depending on the layout of the site, to maintain the operation's required setbacks to the property line or to other nearby residences, wells, floodplains, etc. If natural or existing benchmarks don't exist, include a description of the boundary markers, installed at intervals to allow for line of sight from one marker to the next. List of personnel required and the responsibilities of each position. 10. For Large Type 2, and all Type 3 and Type 4 facilities, describe compliance with the personnel training requirements described in Rule .1406 (19)(a) and (b), and .1406 (c). Existing facilities permitted before Nov. 1, 2019 are required to meet the requirements of .1406 (19)(a) by no later than Nov. 1, 2022. Operators of new sites permitted after November 1, 2019, are required to meet the rule within 18 months of permit issuance. 11. A narrative description of the compost process, from beginning to end, to include arrival of materials, unloading, processing, mixing, storage, composting, curing, testing, final product storage, and removal from site. Describe the location that each of the activities takes place, and the estimated time for composting and curing. 12. Method for screening loads for unacceptable waste. Describe plan for handling incoming loads that contain unacceptable waste. Describe storage of the unacceptable waste, the frequency of removal of the waste (at least weekly), and final disposition. 13. Any special feedstock or residual handling (e.g., odorous residuals, liquids, etc.). 14. Any amendment to be added to the compost, how it will be stored, and when it will be added. If wood ash is used, also provide total metals lab testing of the ash, and confirm that metals testing of the finished compost will be after ash is added. 15. Processing activities to prepare materials for composting, such as grinding. 16. Pile sizes for feedstock, composting, curing, and final product storage (width and height). Length is unlimited within the permitted boundary of each area. Describe distance between rows, to provide vehicular access in the event of a fire. Storage of wood debris, mulch, and finished compost should be in rows no larger than 50 feet wide and 30 feet high. 17. Describe compliance with the time, temperature, and turning requirements in Rule .1406 (11), (12), and (13), as appropriate for the feedstock and compost method. Describe location of and spacing of monitoring points, probe depth (at least 24 to 36 inches), monitoring frequency, and recordkeeping. Monitoring frequency during the time and temperature requirement period should be at least every other day, or Monday -Wednesday -Friday if the site is not open on weekends. If the site is operated to meet Rule (13)(a) for PFRP, then Rule (12) is automatically met for VAR. 18. Describe the probe thermometer to be used. Describe calibration of the thermometer at least once per year, to include written documentation of the calibration. Onsite calibration using ice water is an acceptable method. 19. Describe other monitoring, such as moisture content, oxygen level, porosity, carbon to nitrogen ratio testing, etc., including method and frequency. 20. The method of aeration provided, frequency, and the capacity of aeration equipment, for both composting and curing piles. 21. Describe compost testing and the method for collecting samples, in accordance with Rule .1407(b). a. The pathogens sample should be collected as a composite sample from finished compost onsite on the same day it is to be taken to the lab for analysis. The sample should be processed within the hold time required by the lab testing procedure, and this is usually 24 hours. b. The sample that is collected for metals analysis is to be collected and composited over a six-month period (or every 20,000 tons produced) from each batch of compost. See Rule .1407(b)(4) for procedure. 22. Describe distribution and ultimate use of the finished compost. If agriculture nutrient claims are to be made for the compost, for fertilizer or soil additive, the owner is required to meet the requirements of the NC Department of Agriculture and Consumer Services, Plant Industry Division. 23. Describe method for removal from the site, and a contingency plan for disposal or alternative usage of residues or finished compost that cannot be used in the expected manner due to poor quality or change in market conditions. 24. Describe recordkeeping and annual reporting in accordance with Rule .1406 (1)(b), Rule .1406 (19)(c), and Rule .1408. Provide a copy of the temperature log forms and other recordkeeping forms. 25. Describe operational activities for surface water and process water control features (for example, drain covers, pipes, ponds, tanks). For onsite tanks, frequency of pumping and removal. 26. Provide documentation that the local fire protection agency has been notified of the site use as a compost facility. 27. Plan for fire prevention and actions to be taken in the event of an accidental fire. Describe equipment provided to control accidental fires. It should be stated that any fire will be reported to the Solid Waste Section within 24 hours, followed by a written notification of the details of the fire within 15 days of the incident. 28. Plan for maintaining facility property in a sanitary condition and actions to be taken to minimize noise, vectors, litter, dust, and other airborne particulates. It should be stated that at the end of each operating day, the unloading area will be clear and all feedstocks will be processed/mixed or properly stored. Describe procedures to prevent blowing litter and dust from leaving the compost area and from leaving the property. 29. Contingency plans for wind, heavy rain, snow, freezing weather and other extreme weather events, air pollution, equipment breakdown, spills, unusual traffic patterns, long-term power outages, cracks in concrete pads, etc. 30. Site safety procedures concerning onsite equipment (especially grinders), safety during unloading and loading of materials, and safety to address other possible site hazards to workers or the public. 31. Describe closure of the site when the site ceases operation, in accordance with Rule .1410. Section 5 - Odor Control Plan This section should describe site specific conditions, designed to minimize odors at the property boundary by means such as expanded buffers, consideration of topography and wind patterns, or process layout design. The plan should include the following: Identification of all onsite potential odor sources on a map or diagram (examples, unloading area, mixing area, active compost windrows, etc.). Description of onsite weather conditions that may affect odor migration, such as prevailing wind direction, topography, and seasonal variations. Plan to monitor onsite odor and record odor data for the odor sources with the potential to migrate offsite. Data shall include date, time, site specific conditions, weather conditions, wind direction, and characteristics and intensity of odor. 4. Description of the facility's odor complaint protocol, including forms used, odor verification by operator both onsite and offsite, what the response will be, and who will be contacted. 5. Description of complaint record keeping. 6. Description of odor control design and operating best management practices to be used onsite, including: a. Personnel training; b. Feedstock characteristics; c. The initial mixing of feedstocks to reach targeted carbon to nitrogen (C:N) ratios and moisture levels; d. Procedure for handling incoming odorous feedstocks, to include prompt mixing of the waste with carbon material; e. Maintenance of compost piles for moisture; f. Aeration methods, frequency, and protocol; g. Leachate and liquids management; h. Weather monitoring and protocol; i. Management of airborne emissions; and j. Windrow covering, such as the application of 3 to 6 inches of finished compost cover over piles. 7. For indoor facilities, describe the design and operation of biofilters, if applicable, and procedures for equipment breakdown. Section 6 —Signature Pages Place signature page(s) at the end of the application text, before the appendices. Applicant signature page (see attached). If the landowner of the property is not the applicant, the attached certification form by the land owner is required. Section 7 — Stormwater Discharge and Sedimentation and Erosion Control Plan For new facilities or existing facilities with proposed construction modifications, provide: A copy of the sedimentation and erosion control plan/stormwater discharge and permit as required by local governments and/or NC DEMLR. Calculation pages are not necessary. A copy of the DEMLR stormwater/process discharge application and permit. Calculation pages are not necessary. Section 8 —Drawings Provide drawings for a new facility or an existing facility with proposed modifications that would change the previously submitted drawing(s). For Large Type 3, and all Type 4 facilities, engineering drawings should be prepared and sealed by a NC professional engineer. Drawings should be drawn to scale and include: An aerial photograph, where one inch is less than or equal to 400 feet, accurately showing the area within one-fourth mile of the proposed site's boundaries. It may be included in the Siting Requirements Section, if it can be appropriately sized 11x17. The following should be drawn onto the map: a. Boundaries of entire property owned or leased by the person proposing the facility; b. Location of all homes, wells, industrial buildings, public or private utilities, roads, streams, water bodies, intermittent streams/ditches, and other applicable information regarding the general topography within 500 feet of the facility. 2. Site plan drawing(s) where one inch is less than or equal to 100 feet that delineates the following: a. Existing and proposed contours, at intervals appropriate to the topography. b. Setbacks from the operations area to property lines, residences, wells, and perennial streams/rivers and water bodies. The operations area includes unloading, mixing, feedstock storage, composting, grinding/processing, and curing areas. c. Access roads, existing and proposed, and gates/fences or other access control features. d. Streams, water bodies, floodplains and wetlands located on the property. e. Existing and proposed location and elevations of berms, ditches, basins, and other water control features for the diversion and management of surface water and process water, and sedimentation and erosion control. Labeled areas for unloading, mixing, processing, composting, curing, material storage, and final product storage. Illustrate the location of all piles and windrows onsite, including feedstocks, active compost, curing, finished compost, and amendments. Drawings should show that all sides of storage areas for flammable feedstocks and compost will be clear and drivable, to provide vehicular access in the event of a fire. g. Labeled ground cover (gravel, soil pad, concrete, asphalt, etc.). h. Utilities and structures/buildings, existing and proposed. i. Other physical characteristics of the site, as applicable. If applicable, detail drawings of the following: a. Compost bins, bays, or vessels. b. For indoor operations, plan and profile drawings of the buildings, with areas and features labeled.
