Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Section staff met onsite to inspect yard waste notification and NLCID N0587 Closed and to introduce themselves to facility staff. N0587 Closed / Pre Regulatory LF NONCD0000147 2. Before inspection, Mr. Powell reviewed records on Town of Clarkton’s facilities. The Notified Land Clearing and Inert Debris Landfill was mentioned that it “never has been used as a landfill according to the Public Works Director,” in the inspection dated 8/13/2009. Also, that inspection stated that the Town would like to close it at that point. Upon inspection on 3/4/2021, there was some clean concrete waste present in a very small area on the northern border, near YWN site . This waste should be removed and disposed of properly at another landfill for this waste type. Keep documentation of this. The Town will need to be sure this area meets closure requirements of 15A NCAC 13B .0567. This area is also near or partly atop a closed Pre Regulatory Landfill. It’s very important that it is not disturbed in the close out activities or in the future. Ryan Channel, Supervisor for this Section, will be copied on this report. Yard waste has been taken for years, based on onsite discussion with Mr. Hall, windrowed and turned periodically then spread out for disposal. No time or temperature records are being recorded. This is not permitted or allowed with a yard waste notification. A yard waste notification, is a small type 1 compost facility, is for storing, processing and then waste must be removed. The Town of Clarkton will need to remove all material onsite and any older waste that have been spread out before it can be closed. No material can be given to the public unless it has meet the time and temperature requirements of 131 degrees Fahrenheit for three consecutive days. All unapproved wastes removed and disposed of properly. There were some plastics and bottles visible during inspection and should be removed before grinding or hauling to another site. Take a picture of removed materials or provide weight tickets. 4. Mr. Hall is eager to clean up this site, get it into compliance and close this yard waste notification/NLCID N0587 officially. Onsite discussions consisted of disposal methods and options moving forward. Mr. Hall stated Waste Management out of Elizabethtown would be hauling the material for disposal at Bladen County’s site. The removal of this material should be made a priority. Mr. Hall also indicated someone would be contracted to chip and haul what is currently onsite. On 3/15/2021 Mr. Hall shared a contract payment invoice between the Town of Clarkton and Hickman Utilities INC. to remove all tree debris and excavate 1 ft. deep to a disposal area. Be sure the area of the Pre Reg LF is not excavated at any time . Mr. Hall also indicated moving forward Town citizens would be limited to leaf and limb size of 3 inches or less for them to haul to Bladen County for disposal. All other debris will be responsibility of the citizen to dispose of properly. Mr. Hall wrote a notice for the citizens and provided a copy to Mr. Powell. Mr. Powell would suggest sending the Town citizens a Waste Management guidance document from 2011 to help educate on what’s not accepted disposal methods that are historically an issue. A copy was provided when emailing a copy of this inspection. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 4 of 4 5. Please keep copies of all documentation, load volumes and where the waste goes etc, and submit to Waste Management. 6. Corrective measures are necessary as result of this inspection. A follow up compliance inspection will be conducted by Solid Waste Section Staff in about 60 days. Failure to meet the conditions for compliance may result in Compliance Actions. Keep in mind if the Town doesn’t follow through with closure of the notification, there are other issues that will need addressing to keep and operate it as a yard waste notification. For example, time and temperature records must be recorded and the site could not have more than 6,000 cubic yards onsite at any one time. If the City doesn’t remove and close out this facility in a timely manner, then the site should be compliant with all operational guidelines of the 15A NCAC 13B .1406 rules for Small Type 1 Compost facilities (Yard Waste Notifications).
