The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. Section staff met onsite to inspect yard waste notification and to introduce themselves to facility staff.
2. Before meeting onsite, Mr. Powell discussed over phone and email with Mr. Sutherland the current state of the facility and options for addressing current issues with older material not being removed. The material onsite is older and has lost much of its compositing energy or potential and will probably no longer meet the time and
temperature requirements in the rules. Part of that conversation included guidance from the Sections’ Donna Wilson. In part that sampling guidance she stated, “Since we don’t know if it met composting time and temperature, it should be tested for either fecal coliform or salmonella bacteria, if distributed to the public. It should be representative sampling, more than one sample. A passing test would be <1000 MPN/g for fecal coliform, and <3 MPN/4g for salmonella (the 4 g is not a mistake). The testing is to ensure that contact with the
compost would not potentially make anyone sick. Alternatively, it could be used for boiler fuel and used in non-public places (like mixing with soil for landfill cover), without testing – not sure if that is an option.”
Follow these guidelines and if there are any issues please contact David Powell for assistance. The material cannot go to the public until these have been met, if that’s the disposal method chosen moving forward. In
addition to this guidance, Mr. Powell, sent an email on 3/2/2021 with a link to Sections yard waste guidance page and a copy of the new rule for Beneficial Fill .0562. Mr. Sutherland also indicated, that the City is not using the notification any longer and would like to close it out once the waste is removed.

3. There are some loads of clean concrete onsite that will need addressing as well. A copy of the beneficial rule was emailed on 3/2/2020 for guidance. A copy of the “130A-309.05. Regulated wastes; certain exclusions” rule was sent with this inspection. This rule basically means that 75% of the recovered material, in this case its concrete, shall be reused or gone within a year. This material has been present longer than that time frame and
needs to be crushed and reused if that’s the Cities plans or removed and disposed of properly.
4. Mr. Sutherland is eager to clean up this site, get it into compliance and close this yard waste notification. Onsite discussions consisted of disposal methods. Mr. Sutherland is looking into companies to sample and means for disposal. The removal of this material should be made a priority as well as the concrete waste stored in this area. Any unapproved waste should be disposed of properly. Please keep copies of all sample documentation, load
volumes and where the waste goes etc.
5. Corrective measures are necessary as result of this inspection. A follow up compliance inspection will be conducted by Solid Waste Section Staff in about 60 days. Failure to meet the conditions for compliance may result in Compliance Actions. Keep in mind if the City doesn’t follow through with closure of the notification, there are other issues that will need addressing to keep and operate it as a yard waste notification. For example, there was no sign present, the road to facility would not be considered all weather, time and temperature records must be recorded and the site could not have more than 6,000 cubic yards onsite at any one time. If the City doesn’t remove and close out this facility in a timely manner then the site should be compliant with all operational guidelines of the 15A NCAC 13B .1406 rules for Small Type 1 Compost facilities (Yard Waste Notifications).
