The site is recorded in deed book 2918, pages 723-738. The Notification Letter for N0712 was issued by the Solid Waste Section on December 1, 2006. The site is recorded in deed book 2253, pages 770-772. PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: None OBSERVED VIOLATIONS: None Page 1 of 4 NORTH CAR()LINAD_E Q�� OepaNnent of Envieonm.nbl W.I� FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS A copy of the new LCID rules, which became effective on January 1, 2021, were provided to Mr. Collie at the time of this inspection. Please read through the rules and contact me if you have any questions. Based on rule 15A NCAC 13B .0563 (6), within 5 years of the effective date, all notified LCID landfills will need to be properly closed or will need obtain a permit from the Division of Waste Management. Ms. Thompson and Mr. College recommended that Mr. Collie or his engineer contact permitting to discuss the process to obtain a LCID permit. 1. The sign at the entrance to the landfill is installed and posted as required. Individual signs are also located at each notified site. Please add the recent notification number, N1096, to the sign at the road. 2. The access road to the facility is being managed properly at this time. N 1096 3. Permanent, easily visible markers are in place to show the edge of waste area for the landfill. A portion of the land clearing waste was identified to be slightly outside of the northern edge of waste boundary. Mr. Collie stated that he knew that the waste was outside the boundary and he would work on pulling the waste back inside the waste boundary. The area has received a large amount of rain recently making the access road to the top of the landfill difficult to traverse and move the waste within the boundary. Ensure that the waste is within the edge of waste boundaries. 4. The landfill working face was approaching the less than one acre. Ensure that the working face is densely compacted and covered with soil monthly or when the working face reaches one acre in size, whichever occurs first. Stockpiles of soils used for cover are located adjacent to the access road of the landfill. The cover soils are from a DOT bridge repair/replacement project and are wet when they arrive at the site. Mr. Collie will wait for the soils to dry before using them to cover the landfill. 5. Several pieces of treated wood and green straps were observed near the working face. The treated wood, straps, and any additional unacceptable waste need to be removed and properly disposed of. 6. The side slopes are to be kept at a slope of no greater than 3:1. This includes the working face. 7. Stockpiles of concrete and brick are located to the north of the LCID. Painted brick and metal rebar were identified within the stockpiles. Mr. Collie stated that the brick and concrete would be used on the access roads. Ms. Thompson stated that he could not use painted brick for the roadway unless the paint had been sampled and tested for lead. Mr. Collie stated that he would have the paint tested for lead and provide Ms. Thompson with a copy of the analytical results. The metal needs to be removed from the stockpiles and properly recycled or disposed of. N0712 8. The side slopes are to be kept at a slope of no greater than 3:1. 9. The landfill has well established vegetative cover. No erosion was observed at the time of this inspection. 10. Corrective measures are necessary at this facility. Measures to bring the facility into compliance must be completed within 30 days of receipt of this report. The Solid Waste Section will conduct a follow-up inspection in 30 days to ensure issues noted in this inspection report have been addressed.
