Home Church Road Morganton, NC 28655 PARTICIPANTS: Troy Harrison, NC Solid Waste Section STATUS OF PERMIT: Active Issued: June 29, 2016 Expired: March 1, 2021* *Permit renewal application received PURPOSE OF SITE VISIT: Permitting Inspection STATUS OF PAST NOTED VIOLATIONS: The violation of 15A NCAC 13B .0841 (i) for failure to keep the area around the tanks free of vegetation to allow for access and inspection for a distance of at least 5 feet has been resolved. OBSERVED VIOLATIONS: N/A ADDITIONAL COMMENTS 1. The Septage Detention and Treatment facility (SDTF) consisted of two 5,000-gallon steel tanks for storage of domestic septage. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. The longer septage is stored in a tank the more difficult it will be to remove. In addition, it would be a violation of North Carolina Septage rules if any of the septage material spills out of the top. Top of Tank next to road 3. It appears that set-back/buffer requirements have been met. 4. Appropriate signage was in place at the entrance to the access road. 5. All weather roads are maintained for access to the site. 6. During the previous inspection, both tanks were observed overgrown with vegetation. This violation has been resolved; however, there is still a small tree growing between the tanks that needs to be removed. North Carolina Solid Waste Rules require that the area around tanks to be free of debris and vegetation to allow for access and inspection for a distance of 5 feet. 7. No odors were observed around the tanks.
