Life of Site, issued on December 10, 2019 and expires on October 08, 2053. PURPOSE OF SITE VISIT: Comprehensive Facility Compliance Inspection. STATUS OF PAST NOTED VIOLATIONS: Continuing from April 17, 2020 inspection. OBSERVED VIOLATIONS: 15A NCAC 13B .1626 OPERATIONAL REQUIREMENTS FOR MSWLF FACILITIES: (2) Cover material requirements; (a) Except as provided in Sub-Item (b) of this Item, the owners or operators of all MSWLF units must cover disposed solid waste with six inches of earthen material at the end of each operating day, or at more frequent intervals if necessary, to control disease vectors, fires, odors, blowing litter, and scavenging. (b) Alternative materials of an alternative thickness (other than at least six inches of earthen material) may be approved by the Division if the owner or operator demonstrates that the alternative material and thickness control disease vectors, fires, odors, blowing litter, and scavenging without presenting a threat to human health and the environment, in accordance with 40 CFR Part 258.21. A MSWLF owner or operator may apply for a generic approval of an alternative cover material, which would extend to all MSWLF units. (c) Areas which will not have additional wastes placed on them for 12 months or more, but where final termination of disposal operations has not occurred, shall be covered with a minimum of one foot of intermediate cover. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 5 ADDITIONAL COMMENTS: 01 - This inspection is a Comprehensive Facility Compliance Inspection. 02 - Facility has employed a New Operations Manager - Cardelle (Pat) Patrick. First inspection along with Mr. Patrick. 03 - The windblown litter issue appears to be resolved during this inspection. 04 - The working face has a fence around the outside to capture windblown trash. 05 - Leachate tank area looks good and tanks have adequate storage available. 06 - Facility burns off landfill gas. The system appears to be working correctly looking at the flares. 07 - Groundwater Monitoring Wells that were inspected, were locked and had tags with information present. 08 - All the roads were maintained (as well as possible, due to recent weather) and are constructed of all-weather material. 09 - Records were not reviewed onsite during this inspection due to Covid-19. Matt Einsmann and John College discussed the records to be emailed for review for this inspection. 10 - The records were emailed to John College on February 24, 2021 from Matt Einsmann. 11 - The records reviewed on March 01 & 03, 2021. 12 - The facility has required Certified Landfill Operations Specialist. 3 Certifications were email: Mitch Hoggard, expires 11/15/2022, Todd Frazer, expires 11/15/2022 and Michael Bazemore, expires 11/15/2022. 13 - The facility has 1 Certified MOLO Staff: Joseph Dehner; expires 06/10/2022. 14 - Leachate removal records were emailed and reviewed. 15 - Soil cover records were emailed and reviewed. 16 - Semi Annual Water Quality Monitoring Reports were emailed and reviewed. 17 - Random Waste Inspection records were emailed and reviewed. 18 - Incoming ADC records were emailed and reviewed. 19 - Matting has been added to help prevent erosion. 20 - Several areas were being worked on due to small leachate breakouts. 21 - The leachate breakouts are contained in the outer ditch with check dams around the landfill and being pumped back into the leachate collection system. 22 - Site is secured with fencing and signage with required information noted. 23 - An inspection will be conducted within 30 days of this report to ensure the Observed violations (page 1) have been corrected. 24 - All COVID-19 CDC Recommendations were followed during this inspection. 25 - Digital pictures were taken of the observed violations and some are attached to this report. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
