PURPOSE OF SITE VISIT: Permitting STATUS OF PAST NOTED VIOLATIONS: N.A. OBSERVED VIOLATIONS: 1) Upon review of the submitted land application records, it was noted that the monthly application rates were exceeded once in 2016, and 2017. Exceeding the monthly application rate is a violation of Rule .0842(a)(17) that states “approved nutrient management plans shall be followed.” The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 2 ADDITIONAL COMMENTS 1) Land application logs for January 2016 through October 15, 2019 were submitted along with the application for permit renewal. For Field 3 in 2016, the monthly application rate of 10,000 gal/ac for November was exceeded. Records showed that 28,500 was applied to Field 3 in November of 2016. At a monthly rate of 10,000 gal/ac, only 28,000 gallons should have been applied to Field 3 in November (10,000 gal/ac * 2.8 ac = 28,000 gal). In 2017 for Field 3, the monthly application rate of 5,000 gal/ac for December was exceeded. Records showed that 16,000 gallons was applied to Field 3 in December of 2017. At a monthly rate of 5,000 gal/ac, only 14,000 gallons should have been applied to Field 3 in December (5,000 gal/ac * 2.8 ac = 14,000 gal). The monthly amount applied to each field was typically significantly below the monthly application rate. The maximum application rate was not exceeded for the site or any field from 2016 through 2019. Please watch the amount you apply each month so that you do not exceed your monthly application rates. 2) Permit was issued on 08/21/2020 with an expiration date of 1/1/2025.
