OBSERVED VIOLATIONS: NONE The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 2 ADDITIONAL COMMENTS 1) Received complaint of Victory Septic dumping waste pumped from septic systems on their property, digging holes with backhoe, and strong waste smell. I inspected the place where the pump trucks are parked, the office location, and Victory’s permitted Septage Detention Facility and Septage Land Application Site. 2) “No Trespassing” sign was at tank location as per 15A NCAC 13B .0838(k). 3) Access road in good shape as per 15A NCAC 13B .0838(b). 4) Tanks accessible for inspection. A five (5) feet area around the tanks was clear of debris and vegetation as per 15A NCAC 13B .0838(i). 5) Both above ground steel tanks appeared to be structurally sound as per 15A NCAC 13B .0838(c). No leaks noticed. 6) Septage appears to be transferred to and from the tanks in a sanitary manner as per 15A 13B .0838(j). No septage spills noticed on the ground or on the tanks. 7) No odor or vector issues noticed. 8) No change noticed that would affect setback distances. 9) No violations or issues noticed. 0BPicture of the 2 tanks.
