OBSERVED VIOLATIONS: 1) The updated Firm name of “The Water Specialist” that was on the cab doors of the pumper vehicle with License Tag #, YA118368, was less than three (3) inches in height. This is a violation of Rule .0835(f) that states “All permitted septage management firms shall display lettering on each side of every pumper vehicle operated by the firm. The lettering shall include the firm name, town name, phone number, and septage management firm permit number as shown on the firm application. All lettering required by this Rule on the pumper vehicle shall be no less than three inches in height and legible, distinguishable from the background, and not obstructed from view. Identification shall not be removable (i.e. no magnetic signs).” Lettering needs to be three (3) inches in height or greater. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 3 ADDITIONAL COMMENTS 1) Pumper vehicle(s) inspected: TRUCK LICENSE PLATE # VIN # TANK CAPACITY (gal) (New) KJ2569 1FVACWDUOCHBL6251 1,600 YA118368 3BKBJ9X0GF497350 3,200 2) Inspection conducted to inspect the new pumper vehicle and the pumper vehicle currently in use. The company is also changing the Firm Name from JC Johnson Septic Service to The Water Specialist. 3) The firm name, town name, phone number, and firm permit number were on both sides of the pumper vehicles. The letters were three (3) inches or greater in height on the new pumper vehicle. The lettering of the firm name, “The Water Specialist,” on the pumper vehicle with License Plate #, YA118368, was less than three (3) inches in height. The letters for “The Water Specialist” need to be changed so that they are three (3) inches in height or greater. When the lettering is redone on the tank, the permit number needs to be moved some so that the hose does not partially block the permit number on the driver side of the pumper vehicle. See pictures of the pumper vehicles below. 4) The tanks on the pumper vehicles were made of metal and affixed to the frame of the truck as per 15A NCAC 13B .0835(a)(1). 5) The gate valves on both pumper vehicles appeared to be in working order and closed as per 15A NCAC 13B .0835(a)(2). Caps present on hose ports. 6) Access ports on tanks appeared to be in good repair and sealed as per 15A NCAC 13B .0835(a)(3). 7) No leaks noticed from either pumper vehicles as per 15A NCAC 13B .0835(a). 8) The pumper vehicle with License Plate #, KJ2569 passed inspection. The letters for “The Water Specialist” on the pumper vehicle with License Plate #, YA118368, need to be changed so that they are three (3) inches in height or greater.
