PURPOSE OF SITE VISIT: Pre Operation Inspection STATUS OF PAST NOTED VIOLATIONS: N/A OBSERVED VIOLATIONS: NA The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Drew Hammonds and David Powell with Section inspecting new LCID for Pre Operating conditions. Currently site has 4 Edge of Waste (EOW) markers, and erosion fence installed. Only 2 acres are prepared for operations of the 5 acres. If this facility wishes to operate in phases or cells, it should be in the approved plans/application. Otherwise facility should be operated as designed. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 3 of 4 2. Facility is in two parts. Refer to picture above in #1. On left is the approximately 3 acres of high elevation and the right area surrounded by erosion control fence and of lower elevation is the 2-acre area that the owners have prepared for inspection. An all-weather road goes through center of this site and is to the left of this view in the picture, running away from camera. Owners indicate the idea is to allow trucks to back up to the edge of this road, along the lower elevation 2-acre area, and dump over side, then compact and cover then slope. Entrance to 2-acre lower elevation area from all-weather road and center of 5 acre LF approved area. 3. The road for this facility is not located correctly on the maps submitted to the Section. An updated map showing the road correctly should be submitted to the Section. 4. Sign up front needs updating. Permit refers to rule 15A NCAC 13B .0566(14). 5. Operator is waiting for DEMLR mining permit. Be sure and follow up with DEMLR to ensure they have everything they need for this site. Communicate with their staff about Storm water/Sedimentation Erosion Control Plan (SECP) in addressing the short circuiting of the installed water control structures onsite. These should also be repaired according to approved SECP/rules. If adjustments need to be made, then update the plan/documentation. Sediment was observed outside the permitted boundaries and in the adjacent trees. Erosion control measures, structures or devices shall be utilized to prevent silt from leaving the site and prevent on-site erosion, and shall comply with 15A NCAC 04 (15A NCAC 13B .0566 (5)). 7. Ensure that during all development, operation and closure activities, side slopes do not exceed 3:1 (15A NCAC 13B .0565 (K)). 8. After viewing the new permitted site, records were viewed outside back at 401 Sand office, including permit and maps of site. 9. Operator should repair and develop all aspects of the facility according to approved plans, have approved mining permit in hand, and made any adjustments to these documents that are needed before requesting a Pre Operation Inspection from the Section. Facility cannot accept waste until these steps have been completed and a Pre Operation Inspection is completed by Section staff confirming.
