STATUS OF PERMIT: Notified LCID PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: N/A OBSERVED VIOLATIONS: 1. 15A NCAC 13B .0566 (3) All waste shall be covered with no less than six inches of soil monthly, or when the working face reaches one acre in size, whichever occurs first. Any soils used for cover at the site shall meet unrestricted use standards for soils as defined in G.S. 130A-310.65. A large area was uncovered and one area on back and new 50 ft. extension. An area on backside was uncovered and was uncovered last inspection. Continue working on all sides of the landfill and maintain the 3:1 slopes. Be sure and cover once reaches one acre in size or after one-month waste is put into NLCID. This was mentioned last inspection. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 4 ADDITIONAL COMMENTS 1. Establish vegetation to hold soil and reduce erosion. Most of NLCIDLF has good shape and sloping. Be sure and fix erosion rills on side slopes from recent rainfall. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Again, cover when reaches one acre or 30 days from receipt of waste. Cover, slope and establish vegetation. 3. Remove all unapproved waste as soon as it is observed. Some on top LF was removed by Mr. Byrd while inspecting. Good job. 4. Concrete crushing and separating is needed now. Stockpile has grown considerably. Section staff explained 75% rule (§ 130A-309.05. Regulated wastes; certain exclusions) and the need for material to be removed otherwise it becomes disposal. Also there was some painted concrete in the stockpile. This waste should go to a CDLF permitted to accept that type of waste. Ensure that during all development, operation and closure activities, side slopes do not exceed 3:1 (15A NCAC 13B .0565 (K)). 7. Corrective measures are necessary as a result of this inspection and should be complete within 30 days’ receipt of this inspection report.
