A Permit to Operate was issued to the City of Durham for the Durham Compost Facility, permit number 3204-
COMPOST-1991, on July 9, 2018 and expires on July 9, 2023.

The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS
3204-COMPOST-1991:
The Durham Compost Facility is located at 2115 E. Club Boulevard, behind the closed City of Durham MSW Landfill,
Permit 3201. The property also contains the City of Durham Transfer Station, Permit 3212 and the City of Durham
Household Hazardous Waste Facility, Permit 3212.
The facility is permitted to accept only yard waste, land clearing debris, and clean wood waste (Type 1) for
processing (grinding) and composting. The approved compost method is aerated static pile composting (ASP). Atlas
Organics manages the operations of the compost facility.
The following observations were made during the January 12, 2021 inspection:
1. The facility is no longer composting using the ASP method. Incoming material is ground into a single shredded
mulch and then moved to the Water Resources permitted site for composting. Please update the sites
Operations Plan with Solid Waste Section's Permitting Branch to reflect changes made to your
operations. The Permit Engineer for this site is Jordan Russ, jordan.russkncdenr.gov.
2. Due to heavy, consistent rains, some areas of the compost facility were rutted and holding water. These
areas of ponding were in the processing area but, for the most part, were not in/around the waste. When
the weather dries up, repair these areas to shed surface water.

3. Interior roadways must be of all-weather construction and maintained in good condition, and all sides of
storage piles for flammable materials must be clear and drivable, to provide vehicular access in the event of
a fire. During the inspection, the interior roadways were not all drivable due to ponding water and
mud. Atlas Organics is exploring the option of creating a more weather resistant pad for the operational
area and road through the site.

4. The facility is adequately secured by means of gate and fence. A sign is at the entrance of the site with the
appropriate permit information.
5. No trash and unacceptable wastes was observed. Good job
