Box 865 West End, NC 27376 FACILITY CONTACT NAME AND PHONE NUMBER: Name: Jeff Kerr Telephone: (910) 295-1899 Email address: jeff@marlinw.com Fax: N/A FACILITY CONTACT ADDRESS: 140 Knox Lane West End, NC 27376 PARTICIPANTS: Connie Wylie, Adam Ulishney Jeff Kerr, Doug Lassiter STATUS OF PERMIT: Active – permit expires December 31, 2021 PURPOSE OF SITE VISIT: Follow up to Notice of Violation issued December 17, 2020 STATUS OF PAST NOTED VIOLATIONS: .0837(a) – it was noted during this inspection that the white tanker and the blue frac tank referenced in the Notice of Violation issued on December 17, 2020 have been emptied of waste. An on-site meeting occurred which reviewed/discussed the Septage Management Rules, issues & site concerns. The corrective actions listed in the Notice of Violation have been resolved at this time. OBSERVED VIOLATIONS: N/A SEE NEXT PAGE The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. The frac tank that was emptied now has lettering on both sides of this vehicle. 20,000 gallon capacity. Tag#SE492686, SAGSBA710W5245019. The four other frac tanks on site (with no lettering) are also empty. The white tanker on site (1UNST4227BL08815) does have lettering on both sides, has no tag and at the time of this inspection had a hose connected to it and was empty. In accordance with 15A NCAC 13B .0837(a) and 15A NCAC 13B .0835(f), at no time shall septage be placed in these tanks at this site. At this time there is no vehicle on site available to pull either the white tanker or the frac tank. Mr. Kerr indicated that a vehicle would be rented when needed to perform this activity. 2. Inspected a new pump truck to be added to the septage management firm permit. Tag#KF4537, 1500 gallon capacity, VIN#3FRWX66Y57V512296. The tank appeared structurally sound & securely attached. Outlet covers were on and no drips/leaks were noted. Both sides of this vehicle were lettered. However the phone number displayed on this vehicle was 910-999-PUMP which is displayed on some of the other permitted vehicles. Neither this phone number or the 910-295-1899 phone number displayed on some of the other permitted vehicles are listed on the firm application recently submitted for the 2021 firm permit. Correct the firm application to reflect both phone numbers that are displayed on the permitted vehicles. The Notice of Violation, the audit report of 12/11/2020 and the Septage Management Rules were discussed at length during this site visit. In regards to 15A NCAC 13B .0835(f) Vehicles used in the transportation of septage, that are listed on an approved septage management firm permit application, may remain loaded or partially loaded on land owned by the septage management firm for up to seven days without obtaining a permit for a detention or treatment facility. Upon further discussion within the Division it has been determined that permitted vehicles covered under this firm permit and parked at this location on Knox Lane may not be loaded or partially loaded because this property is being leased. As such the white tanker or any other permitted vehicle may not store septage at this location per this rule. Discussions are still ongoing within the Division in regards to the blue frac tanks being used as permitted vehicles and a decision has not yet been reached.
