STATUS OF PERMIT:
In 1973. Landfill operations began in Phase 1 on this property. Facility permit 51-03 is a combination of facility permits
51-01 and 51-02.
Permit to Construct Johnston County MSW Landfill, Phase 6 issued May 8, 2020.
Permit to Operate 5103-MSWLF Phase 4A and 5103-CDLF Area 2 Cells 1 and 2 issued May 8, 2020.
Permit for Closure for MSW Phases 1 through 4 and C&D Area 1 issued May 8, 2020.
Life of Site Permit for 5103-MSWLF and 5103-CDLF issued May 8, 2020 and will expire August 8, 2057.
PURPOSE OF SITE VISIT:
Partial Compliance Inspection and Follow-up to a Leachate Release
STATUS OF PAST NOTED VIOLATIONS:
None
OBSERVED VIOLATIONS:
A. 15A NCAC 13B .1626 (8)(d), "Leachate shall be contained within a lined disposal cell or leachate collection
and storage system."
The Johnston County Landfill is in violation of 15A NCAC 13B .1626 (8)(d) in that leachate was not contained

within a lined disposal cell or leachate collection and storage system. At the time of this inspection, leachate was
observed to have flowed from the origin, along a drainage ditch to a culvert and into and across the newly
constructed Phase 6 to an outfall along the western side of Phase 6.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS
On January 21, 2021, Mr. Rick Proctor contacted Amanda Thompson to self -report a leachate release. The release was
reported to Mr. Proctor by an operator at the end of the day on Wednesday, January 20, 2021. The release was located at
the southern end of Phase 5, adjacent to the gas collection lines. Mr. Proctor stated that pressure on a pipe had blown a cap
off the end of the pip and forced leachate out of the pipe. The leachate flowed from the origin, along the ditch to a culvert
under the roadway around Phase 5 and into Phase 6. The leachate flowed across Phase 6 and was stopped in the outfall on
the west side of Phase 6. Mr. Proctor had a vacuum truck staged near the outfall to pump out the leachate. Mr. Proctor
estimated that 15,000 gallons of leachate had been removed from the outfall. Joan Smyth, from Smith + Gardner, was also
on -site during this inspection to oversee the leachate remediation efforts. Ms. Smyth stated that a sampling plan would be
submitted to the Section for approval prior to sampling. The pipe that caused the leachate release had been permanently
capped to prevent future releases. An operator was excavating the area of the release, in order to allow the leachate to flow
back into the landfill. Any waste excavated was immediately taken to the working face of Phase 4A. The excavated area
would be repaired with compacted soil and vegetative cover would be established.
1. The facility is fenced and is secured by a locking gate when it is not open for operation.
2. The correct signage is at the entrance of the facility listing the facility name, permit number and emergency contact
information as well as materials accepted at the facility.
3. The facility accepts waste Monday through Saturday from 8:00 am until 4:45 pm and closed on Sunday.
4. The permit, and operations plan, and records were not reviewed during this inspection.
5. The landfills had no woody vegetation and were mowed.
6. Permanent edge of waste (EOW) markers were in place and being maintained.
7. The perimeter road is being well maintained.

8. The areas of exposed waste identified during the November 17, 2020 inspection had been mostly covered.
9. Erosion rills were identified along the southern side slopes. Mr. Proctor stated that erosion was a constant battle,
and the rills would be repaired. Vegetative cover would be established after the rills had been repaired.
10. The working face at the MSWLF appears to be kept small and appeared to be well compacted with no unacceptable
wastes observed. Several loads of cover dirt were delivered to the working face during the inspection.
11. No additional leachate releases were observed during this inspection.
CDLF Area 1
12. Any C&D waste received at the landfill is being disposed of in the MSWLF.
13. Numerous erosion rills were observed along the side slopes of CDLF Area 1 and were in the process of being
repaired and graded.
Yard Waste
14. The yard waste area had been ground and was windrowed. Mr. Proctor stated that the ground yard waste in the
wettest portion of the yard waste area is being used around the landfill.
15. Water was observed between the windrows in the northern portion of the yard waste processing area. Mr. Proctor

stated that the yard waste area would be graded and repaired once the yard waste had been used at the landfill. It
was recommended that measures begin to address the standing water in the yard waste area.
16. The active yard waste area had moved across the access road to a drier area.
17. No unacceptable waste was observed within the waste stream. Landfill staff were in the yard waste processing
area when yard waste loads were dumped.
18. Corrective measures are necessary as a result of this inspection.
19. Photographs were taken during this inspection.
CORRECTIVE ACTIONS
1. In response to the leachate release, submit a sampling plan to the Section for approval prior to sampling.
The proposed plan shall be submitted in electronic format sent via email to Amanda Thompson at
amanda.thompsonOncdenr.gov and Christine Ritter at christine.ritterOncdenr.gov and meet the
following requirements:
a. Include a map/aerial photo depicting area of impact and proposed sampling locations;
b. Provide a description of the proposed sampling methodology; and
c. Describe proposed subsurface soil sampling and surface water sampling (if applicable) at specific
locations, including background soil and upstream water locations, to evaluate the extent of the
potential environmental impacts from the release(s) at the facility;
i. Subsurface soil samples shall be collected between one to two feet below ground surface;
ii. Discrete soil samples shall be collected. Composite samples will not be accepted; and
iii. All soil and surface water samples shall be analyzed by a NC certified laboratory for 40
CFR Part 258 Appendix I parameters (VOCs and Total metals), total phosphorus, sulfate,
nitrate and pH.
After Section approval of the sampling plan, the plan shall be implemented within seven (7) days. Within
10 business days after receiving the analytical results from the laboratory, submit documentation
regarding the sampling event which shall include the following:
a. A summary of the leachate release, actions taken to address the release, and the release assessment;
b. A map/aerial photograph depicting the sampling locations;
c. A table of the surface water analytical results compared to the NCDWR Surface Water Quality
Standards & Protective Values;
d. A table of the subsurface soil analytical results compared to the NCDEQ Preliminary Soil
Remediation Goals (PSRGs) must be met;
e. The associated laboratory reports from the NC certified laboratory including the chain of custody
and QA/QC results;
f. The sampling methodology, if different from the proposed plan; and
g. Conclusions and recommendations
2. Within 30 days of receipt of this report, apply soil cover to the erosion rills and implement erosion control
measures necessary to stop onsite erosion.
