The Notification is recorded in Deed Book 2295, Page 738-740. PURPOSE OF SITE VISIT: Follow-up Compliance Inspection STATUS OF PAST NOTED VIOLATIONS 15A NCAC 13B .0566 (4), "Adequate soil cover shall be applied monthly, or when the active area reaches one acre in size, whichever occurs first." PARTIALLY RESOLVED: At the time of this inspection, a majority of the site had been covered with soil. The area near the northeastern corner of the site, has not been completely covered with soil. Cover needs to be applied monthly or when the active area reaches one acre, whichever occurs first. 15A NCAC 13B .0566 (2), "The facility shall only accept those solid wastes which it is permitted to receive." PARTIALLY RESOLVED: The unacceptable waste that was identified in the September 24, 2020 inspection was not identified at the time of this inspection. However, a strip of plastic siding was observed to be sticking out of the ground near the northern edge of the waste. Unacceptable waste needs to be removed and properly disposed of at a permitted facility. RESOLVED: At the time of this inspection, the LCID waste appears to have been compacted as densely as practical. 15A NCAC 13B .0564 (9) (b), "The facility shall meet the following buffer requirements ... 100 feet from the disposal area to property lines, residential dwellings, commercial or public buildings, and wells." UNRESOLVED: At the time of this inspection, it appeared that the waste had not been moved away from the property lines and was encroaching on the buffer on the north side of the property. The Summit LCID currently occupied Parcel Number 0706077, which is 1.99 acres in size. The Summit LCID parcel is land locked by Parcel Number 0700046. The waste located at the site must be at least 100 feet from the property line. In order to meet the buffer requirements, Mr. Myrick could either recombine the two parcels, 0706077 and 0700046, or move the waste away from the property line to meet the 100-foot setback. During the December 3, 2020 inspection, Mr. Myrick stated that he would immediately go to Halifax County and have the parcels recombined. OBSERVED VIOLATIONS None. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS: 1. Ensure that all waste is within the Edge of Waste Markers (EOWMs) and the EOWMs indicate the area under 2 acres. EOWMs should be visible one to the other. The EOWMs were not visible on the northeast side where waste was observed. 2. The property lines should be marked as well to ensure that the buffers are being properly maintained. 3. Concrete debris was stored outside of the LCID landfill footprint. The concrete debris was located to the west of the LCID. The concrete must be placed within the waste footprint and covered if it is to be disposed of. If it is to be recycled, it should be removed from landfill parcel and 75% must be processed, used and removed from the property within the calendar year it was placed on site, as stated in §130A 309.05 (c)(1), "Seventy-five percent (75%), by weight or volume, of the recovered material stored at a facility at the beginning of the calendar year commencing January 1, shall be removed from the facility through sale, use, or reuse by December 31 of the same year." 4. All slopes of filling, excavation and grading should be maintained at 3: 1. The slopes of the active mining area on the west side of the property and the eastern slope of the landfill, are steeper than 3: 1. 5. Please provide documentation from County that shows the parcels have been combined or remove the waste from the buffers. 6. Do not accept additional waste at this site until conditions for compliance have been met. 7. Corrective measures are necessary at this facility. Measures to bring the facility into compliance must be completed within 30 days' receipt of this report. The SWS will conduct a follow-up inspection in 30 days to ensure issues noted in this inspection report have been addressed. 8. Digital photographs were taken during the inspection.
