PURPOSE OF SITE VISIT: NOV - Follow up Facility Compliance Inspection. STATUS OF PAST NOTED VIOLATIONS: Remediation is being conducted to achieve compliance of past violations. OBSERVED VIOLATIONS: No new violations were observed during this inspection.

ADDITIONAL COMMENTS: 01 - The land on which this Land Clearing and Inert Debris Landfill (LCID) is located, is owned by H.D. Newbern (Estate) and Finley S. Newbern and recorded in Book 401 page 46 of the Currituck Co. Register of Deeds. 02 - The Notification was recorded on July 24th, 1997 in Book 413 Page 825 of the Currituck County Register of Deeds.
03 - Site has locking gate for security at the access point to the facility. 04 - The road is in good condition. Constructed of all-weather materials. 05 - Facility has a CLOSED sign at the locking gate at the facility access point. 06 - Good Progress has been made to get the facility footprint back to less than 2 acres. 07 - The boundaries of the LCID were flagged by Elliott Consulting with grade stakes. 08 - Facility has the 3:1 side slope completed on the west end, now inside of the boundaries of the landfill. 09 - One pile of waste still needs to be moved from the west end to the top of the landfill. 10 - This meeting was scheduled by Currituck County (Savannah Newbern – Currituck County) due to the County Extension for the County NOV expired. Another extension will be granted due to the efforts made at the facility. The State of North Carolina (John College – NCDEQ-DWM) agrees the with the counties extension. 11 - Copies of this report will be sent to Currituck County Staff, Laurie LoCicero, Planning Department Director and Savannah Newbern, Interim Code Enforcement Officer.
12 - Covid-19 regulations were followed during this inspection.

The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
