STATUS OF PERMIT:
The City of Durham Closed MSWLF facility, 3201-MSWLF-1979, ceased operation by December 31, 1997 as stated in the
SWS record of communication, dated January 14, 1998 and in accordance with the January 1, 1998 requirement to cease
operation as stated in the transition plan approval letter, dated July 29, 1996. The facility [initial] transition plan was
submitted to SWS dated April 1994. The revised closure schedule approval letter issued by the SWS, dated June 9, 1998,
approved the completion of closure activities by December 16, 1998.

The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS
The facility is located behind the City of Durham Transfer Facility (3212T), via service road. The service road also
provides access to the City of Durham Large, Type 1 Solid Waste Compost Facility (3204-COMPOST- 199 1) and the City
of Durham Temporary Disaster Debris Staging Site (DS32-004). Both 3204-COMPOST-1991 and DS32-004 are located
behind the closed landfill and the service road used to access these sites is atop the landfill.
The following observations were made during the January 12, 2021 inspection. Please resolve all non-compliance issues
(in bold) within 30 days of receipt of receiving this report.
Surface water shall not be impounded over or in waste. During the inspection, several areas of impounded
water over waste were observed, specifically along the southern and eastern slopes. These areas must be
repaired to shed water. The berms along the eastern slope are holding water, and during the inspection we
discussed options to repair these areas. Any large changes that would impact the way water flows off of the landfill
(such as leveling the berms) must be approved by the Permitting Section prior to implementation. The Permitting

2. Leachate must be contained within the leachate collection system. There were 3 areas where leachate was
sleeping out of the landfill: one seep along the southern slope, just beyond the settlement basin, and two
seeps along the eastern slope. These seeps must be repaired and plugged immediately. The cause of the seeps
needs to be determined. They are likely caused by impounding water further up the side slope.
The well shall be constructed in such a manner that water or contaminants from the land surface cannot
migrate along the borehole annulus into any packing material or well screen area. Landfill gas extraction
wells were uncovered. Any water within the well heads must be removed and lids replaced or well heads
repaired.
4. Repairs to the western and northern side slopes have been made. Good job.
