Home Church Road Morganton, NC 28655 PARTICIPANTS: Troy Harrison, NC Solid Waste Section STATUS OF PERMIT: Active Issued: June 29, 2016 Expires: March 1, 2021 PURPOSE OF SITE VISIT: Routine Inspection STATUS OF PAST NOTED VIOLATIONS: N/A OBSERVED VIOLATIONS: 15A NCAC 13B .0838 (i) states: “The area around tanks shall be free of debris and vegetation to allow for access and inspection for a distance of 5 feet.” During the site inspection conducted on July 22, 2020, it was determined that the facility had significant vegetative growth around the area of the SDTF tanks and preventing access for inspection. The facility was in violation of 15A NCAC 13B .0841 (i) for failure to keep the area around the tanks free of vegetation to allow for access and inspection for a distance of at least 5 feet. In order to achieve compliance, the facility must clear the vegetation from within 5 feet of the base of both above ground tanks by two weeks after receipt of this letter. After completion, submit photographs documenting the clearing of the vegetation by email to: troy.harrison@ncdenr.gov Failure to complete this action could result in further enforcement activity by the Solid Waste Section. The Septage Detention and Treatment facility (SDTF) consisted of two 5,000-gallon steel tanks for storage of domestic septage. 2. The tank next to the road was observed to be almost completely full (see photo below). The longer septage is stored in a tank the more difficult it will be to remove. In addition, it would be a violation of North Carolina Septage rules if any of the septage material spills out of the top. Top of Tank next to road 3. It appears that set-back/buffer requirements have been met. 4. Appropriate signage was in place at the entrance to the access road. 5. All weather roads are maintained for access to the site. 6. Both tanks were observed overgrown with vegetation (see photos below). North Carolina Solid Waste Rules require that the area around tanks shall be free of debris and vegetation to allow for access and inspection for a distance of 5 feet. 7. No odors were observed around the tanks. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
