Permit to Operate shall expire on August 2, 2024. Permit renewal must be submitted to the Section no later than April 2, 2024. PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: None OBSERVED VIOLATIONS: A. March 11, 2019 Permit to Operate Application, Site Design (Page 4, Paragraph 1), "The West Farms Wood Produces wood material treatment and processing facility is in the east central portion of the site and occupies about 6.0 acres (see Total Property Layout & Staging Area — Drawing 2)." Based on the Total Property Layout & Staging Area — Drawing 2, the operations should be taking place directly to the west of the office building. The approved operational area is currently being used by the animal bedding portion of the business. However, during this investigation, the forested area to the north of the approved operation area had been cleared and is being used for wood and creosote utility pole storage and processing. Blackwood Associates must contact Donna Wilson in Permitting at (919) 707-8255 or donna.wilson@ncdenr.gov to discuss the permitting of the currently in use operational area. B. 15A NCAC 13B .0302 (2) "A facility shall only accept waste which it is permitted to receive." And August 2, 2019 Permit to Operate, Attachment 3 (3), "The facility is permitted to receive land clearing debris, untreated and unpainted clean wood material, and creosote treated utility poles." And August 2, 2019 Permit to Operate, Attachment 3 (9), "Unacceptable waste received at the site must be stored in containers and promptly removed from the site for proper disposal." At the time of this inspection, a large pile of blue painted broken pallets was observed to the east of the comingled wood pile. The painted broken pallets were identified to be stored on the ground during the inspection. The broken pallets must be placed in a container for removal and disposal at a permitted facility. At the time of this inspection, approximately 30-40 tractor trailer tires were observed and stored on the ground near the entrance of the facility. The tires were not stored under cover and were identified to be holding water within the tires. Mr. Davis stated that the tires were in a trailer that was brought from Georgia to be used to transport the wood waste to a landfill. Mr. Davis also stated that he was told to try to grind the tires in the wood grinder. The Section told Mr. Davis that according to the Permit, the facility could not receive and process tires. The Section provided Mr. Davis with the phone number and information to Central Carolina Tire in Harnett County, who could receive and process the tires. The tires need to be removed from the site and properly disposed of. C. August 2, 2019 Permit to Operate, Attachment 3 (13), "Fire lanes must be maintained between piles, 20 feet wide, as specified in the approved operating plan." And March 11, 2019 Permit to Operate Application, Site Design (Page 4, Paragraph 6), "The design layout calls for 20-foot fire lanes around and between the stockpiles." At the time of this inspection, the northern most stockpile was not accessible along the northern edge due to the tree line. The stockpile location should be adjusted so that there is a 20-foot fire lane along the northern edge of the stockpile. D. March 11, 2019 Permit to Operate Application, Operating Plan (Page 9, Paragraph 3), "Stormwater best management practices are utilized to prevent soil and other pollutants from accessing surface waters and to prevent excessive on -site erosion. Silt fences are presently in place to prevent silt from leaving the site." At the time of this inspection, the silt fence located along the southern portion of the unapproved operating area was inundated with silt. Silt was identified to have flowed over and around the silt fence and into the adjacent forested lands. The facility needs to clean out and repair the silt fence to prevent the silt from entering the forested riparian area. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. The facility is fenced and is secured by a locking gate when it is not open for operations. 2. The correct signage is located at the entrance of the facility. 3. Operating hours are 7:OOAM to 5:OOPM, Monday through Friday and 7:OOAM to 12:OOPM, Saturday. 4. The permit, operations plan, and records were on site and were reviewed with the operator. 5. The facility is permitted to store up to 2,000 tons of treated wood on -site at any one time based on a demonstrated financial responsibility of $200,000. 6. No vectors were observed during the inspection. 7. August 2, 2019 Permit to Operate, Attachment 3 (12) (b), "Storage of creosote treated material... After grinding, all treated wood must be placed in transportation trailers by the end of each operating day. The material stored in the trailers must be covered to prevent contact with rainwater." At the time of this inspection, the wood grinder was chipping creosote utility poles and depositing the chips directly onto the ground. The facility must ensure that the creosote chips are stored in a trailer and covered to prevent contact with rainwater. 8. Also observed during the inspection were large piles of crane malts, piles of soil with wood waste to be screened a pile of biochar and a pile of waste comingled with clean wood, plywood and other miscellaneous waste. Reportedly the unacceptable waste is removed from the comingled pile and placed into dumpsters for disposal. Waste that does not meet the approval of the permit and operations plan should be removed and disposed of properly as soon as it is observed. 9. Painted asphalt, quartz and granite countertops with backing and rubberized materials were comingled with brick and concrete fill of the access roadway and adjacent to the dryer. The painted asphalt, countertops with backing and rubberized materials do not meet the requirements of beneficial fill; therefore, this non -conforming waste needs to be removed and disposed of properly. 10. Any changes or modifications to the permit, approved operations plan or operations area for this facility should be submitted to permitting before implementation. Recommend that you contact Donna Wilson, Permitting Branch Engineer, to discuss modifications to your operations. 11. Corrective measures are necessary to bring this site into compliance with the permit and approved operations plan and should be completed within 30 days' receipt of this inspection report. 12.
