ADDITIONAL COMMENTS
1. Purpose was to follow up on previous inspection. David Powell and Drew Hammonds met with City Staff onsite to look at areas of concern at the Solid Waste sites the city operates and to discuss options moving forward.
2. The NLCIDLF has grown way beyond the 2 acre notified approved area. Drew Hammonds, Angie Foster and
David Powell walked entire perimeter. It is not known exactly how much of the NLCIDLF is over the Pre-regulatory Landfill (PRLF). This gives cause for concern in regards to digging into NLCIDLF for unapproved waste because the cap of the PRLF may be disturbed or the contents unearthed.
3. Onsite discussions were to CEASE ALL DISPOSAL at the NLCIDLF. Waste should be removed from perimeter ditches with enough room to properly slope and cover the waste. Any Waste in the 50’ buffer to surface waters not associated with the PRLF must be moved from within the buffer as long as it doesn’t disturb the PRLF. Remove what unapproved waste is on top and can be easily removed without disturbing cap of the PRLF underneath. 4. Once meeting buffers, and unapproved waste removed, cover and slope to 3:1 grade. To close NLCIDLF, a foot of soil to cover the entire LF will be needed. Mulched YW can be used for erosion control on slopes, once the NLCIDLF has been covered with 1 foot of soil. The thickness of the mulched YW should not exceed 3 inches in thickness at any one location. Edge of Waste (EOW) marker should be installed to show the corners of the waste. Maintain all disposal tickets for review by Section staff.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

Unapproved waste that needs removal. This pipe goes across entire LF.
5. Contact Tim LaBounty with DEMLR Fayetteville Regional Office for any requirements, Sedimentation Erosion Control Plan needs, etc. at main office number of (910) 433 – 3300.
6. Leachate was discovered leaving waste pushed into ditch on east side. Did not leave onsite while inspectors were onsite. Discussions were to fix immediately to ensure no discharge.

7. Just south of NLCIIDLF and across the access road, is some older vegetative material with lots of unapproved waste comingled with it. Plastic, tires, tarp material and other misc. materials were visible during previous inspection. Some have been removed. Good job. After speaking with Angie Foster with the City, it seems this material is old material that has been stockpiled and never removed. It must be removed and the non-vegetative material must go to the appropriate landfill for disposal. Since this vegetative material is older, it may not have the composting energy to be able to meet the standard of 131 degree Fahrenheit for 3
consecutive days to be able to be distributed to the public. So, it is suggested to dispose of the material in the NLCIDLF or redistribute it slowly into the new material at yard waste notification. If you seek other options, you will need to speak with Donna Wilson in our Section at (919) 707 - 8255. Either way, the material needs to be clean vegetative material for disposal with the other materials going to the appropriate landfill and these areas cleaned up immediately.

8. The City is currently in discussions with Division of Air Quality on permitting an Air Curtain Incinerator to handle a certain amount of yard waste tonnage a year. Please contact Ming Chao, DWM Solid Waste Section Permitting Branch at (919) 707 – 8251 to discuss Solid Waste permitting requirements. 9. Mr. Lighthall discussed a plan to remove all of the telephone poles from the storing area across from the office. Robeson County LF has been contacted and are willing to accept this waste, stated Mr. Lighthall. Upon further investigation, it was discovered the poles have been stored here for many years and the stockpile goes towards a water feature/creek behind them. Please remove all of this waste and its residue. Mr. Lighthall was concerned
with meeting the 30-day time frame, but it’s understandable this is a large task and make take more time. Continued to be diligent and making good efforts at removal, while communicating with David Powell and providing updates and documentation on the progress. If more time is needed, then it can be discussed at the end of that 30-day time frame.
10. Some material has already been removed from NLCIDLF and documentation was provided during this site visit.
Weight ticket for tire stockpile being removed was provided as well. Thank you and good job. In future, Ms. Foster indicated that tires would be stored under the shelter at the first YWN/TDDS shed moving forward. Be sure these do not cause a fire hazard.

11. Waste from street sweeping operations must not be disposed of at LCIDLFs or YWN’s. Street sweeping waste must be disposed of at a solid waste management facility permitted to receive the waste. 12. Send DWM a Corrective Action Plan within 2 weeks of receipt of this inspection on how you will go about these corrective actions, and a realistic time frame of completing the actions needed and outlined in this inspection.
13. Corrective measures are necessary as result of this inspection. A follow up compliance inspection will be conducted by Solid Waste Section Staff. Failure to meet the conditions for compliance may result in Compliance Actions. Please contact me if you have any questions or concerns regarding this inspection report.
