No permit required PURPOSE OF SITE VISIT: Follow-Up Facility Compliance Inspection STATUS OF PAST NOTED VIOLATIONS: Resolved OBSERVED VIOLATIONS: None The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 3 ADDITIONAL COMMENTS: 01 - Access road is constructed of all-weather materials. 02 - Facility has locking gate for security. 03 - Signage has required information. 04 - DS08-010 is also located on this parcel. 05 - Below (6 & 7) are the Observed violations that were noted during the last facility inspection conducted on October 27, 2020. 06 - 15A NCAC 13B .0563 APPLICABILITY REQ. FOR LAND CLEARING/INERT DEBRIS (LCID) LANDFILLS (1) (a) (b) (a) The facility is to be operated for the disposal of land clearing waste, inert debris, untreated wood, and yard trash. Found metals, plastic piping, painted wood, vinyl siding and other non-conforming waste. This Construction and Demolition waste needs to be removed and taken to a permitted landfill. REMOVED. (b) The total disposal area is under two acres in size. Waste is stored outside of the Notified area of less than 2 acres. ALL WASTE IS CURENTLY INSIDE THE FOOTPRINT. 07 - 15A NCAC 13B .0566 OPERATIONAL REQ. FOR LAND CLEARING/INERT DEBRIS (LCID) LANDFILLS (4) (4) Adequate soil cover shall be applied monthly, or when the active area reaches one acre in size, whichever comes first. Height of weeds in exposed Land Clearing waste indicate that cover requirements have not been met. COVER MATERIAL HAS BEEN ADDED. 08 - Facility is currently working on grading side slopes to meet the 3:1 requirement and leveling other areas of the landfill. 09 - This follow-up compliance inspection was conducted later than the date documented on the October 27, 2020 inspection report due to Covid-19, Weather and Holidays. 10 - The facility needs to secure a source of adequate cover material to keep in compliance with the .0566 requirement. Facility has a small amount available at this time. 11 - Having a borrow pit on site would be a viable option. Would need to discuss mining with NCDEQ-DEMLR to see what/or if permit is needed. 12 - Digital pictures were taken during this inspection with some attached to this report.
