The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. The Septage Land Application Site consists of Field 1 (13.8 acres), Field 2 (18.6 acres) and Field 3 (12.6 acres).
2. The site is permitted for land application of domestic septage and grease trap pumpings. 3. The site had accessible all-weather roads to the septage land application field covered under the permit.
4. Appropriate signage was displayed at the entrance to the fields. The fields are also protected by a metal gate. 5. All fields had disposal area boundaries that were delineated with permanent markers which corresponded to the site map. Current Set-back/buffer requirements appear to have been met. 6. Field 1 was in fair condition at the time of inspection.
7. Field 2 was observed with areas where the crop was less than the required 80% ground cover in fescue. The areas had received the most septage from the spray land application. In areas where there had been less land
application, the field appeared to be ok.

Field 3 9. As a reminder, areas that receive heavy, or pooled, septage must be repaired (see photo below).
10. No objectionable odors were observed.
11. The nutrient management plan (NMP) states: Acres that develop with less than 80% ground cover by fescue will be re-seeded with fescue at a rate of 30 lbs./acre – 7-1/2 row drill in September. State regulations require that land application sites or portions of land application sites that do not follow the approved nutrient management plan shall not be used for land application until brought into compliance with the nutrient management plan. 12. On November 12, 2019, the Division received a letter concerning the lack of sufficient cover in the fields. The letter states: “Lack of sufficient cover crop on the site. The second week of September, we spent about $2000.00 on reseeding about 27 acres of site. Guess what, no rain came until about 3rd week of October. That 50 lbs per
acre of fescue was a lost cause. We also sprayed for grub worms and added 30lbs of nitrogen per acre right before the rain came in October. When the fescue started coming up sporadically, it was on determination by
the county agent and I, to go in and drill in rye grass seed at the rate of 40lbs per acre in 7 ½ inches width rows to achieve cover crop. We did this Nov 7 & 8. We set the furrow depth at 3/8 th inches to ½ inches to for quick emergence after germination. Until I get an established cover crop, I will spread on the 18 acres that are
already established with our spreader truck instead of the traveling irrigation gun. This should be adequate acres for our volume of septage we currently pump. Also, my county agent is working on new nutrient management plan for the site.”

13. The use of rye grass (or any ground cover other than fescue) will require a new NMP and any may require a permit revision.
