Markers shall be of adequate height and spacing such that they are visible and distinguishable from the surrounding landscape for determining the disposal boundaries when the site is in use;” On December 9, 2020, Leonard McSwain Septic Tank was in violation of 15A NCAC 13B .0842 a (10) because Field 1 was not adequately marked on the Eastern boundary. In order to achieve compliance, Leonard McSwain Septic Tank must immediately replace the boundary markers and provide written documentation that this has been done by February 2, 2021. Send the documentation to: Troy Harrison, Environmental Specialist II North Carolina Solid Waste Section 2090 US Highway 70 Swannanoa, NC 28778 Or by email to: troy.harrison@ncdenr.gov FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 2 15A NCAC 13B .0842 a (12) states: “all septage discharges, including aerial drift from discharges, shall be made within the permitted boundaries of the land application site;” On December 9, 2020, Leonard McSwain Septic Tank was in violation of 15A NCAC 13B .0842 a (12) because septage was observed outside of the established boundary of Field 1. In order to achieve compliance, Leonard McSwain Septic Tank must provide written documentation of measures that have been taken to prevent future occurrences of waste outside of the established septage fields boundary by February 2, 2021 to the above address. ADDITIONAL COMMENTS 1. The Septage Land Application Site consists of Field 1 with 5.9 acres and Field 2 with 6.9 acres for a total of 12.8 acres. 2. The site is permitted for land application of domestic septage and portable toilet waste. 3. The site is located on Union Church Rd. (SR-1364) and has accessible all-weather roads to the septage land application field covered under the permit. 4. Boundary markers were missing at the eastern side of field 1. Boundary markers must remain in place and immediately replaced when necessary. Field 1 5. All septage discharges appear to have been made within the disposal area boundary with the exception of the eastern border of field 1. Septage was observed outside of the permitted borders. 6. No evidence of standing liquid or pooled waste was observed. The waste appeared to be evenly distributed throughout the fields. 7. No objectionable odors were observed. 8. Appropriate signage was displayed at the entrance. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
