PURPOSE OF SITE VISIT: New Septage Pumping Vehicle
STATUS OF PAST NOTED VIOLATIONS: N/A OBSERVED VIOLATIONS:
1. 15A NCAC 13B .0835 (a) states in part: “Vehicles used for the transportation of septage shall be operated and maintained to prevent leaks and spills of septage”. Leonard McSwain Septic Tank was in violation of 15A NCAC 13B .0835 (a) because the pumper vehicle (VIN 2NKHHJ7X3KM305405) was observed to be leaking from the exit waste valve and around the cap. The division was informed via telephone that the violation had been corrected. Please provide a written explanation of the repairs by February 2, 2021. The document should be sent to:

2. North Carolina General Statute (NCGS) 130A-291.1 (h1) states in part: “A permitted septage management firm shall notify the Department within 10 days of placing a pumper truck in service that was not previously included in a permit issued to the firm and shall make the pumper truck available for inspection by the Department.”
Leonard McSwain Septic Tank was in violation of NCGS 130A-291.1 (h1) because the pumper vehicle (VIN 2NKHHJ7X3KM305405) was placed in operation with notifying the Department within 10 days of placing in operation. No further action is necessary.
ADDITIONAL COMMENTS
1. The inspection was conducted at 1030 Union Church Road, Lawndale, Cleveland County. 2. The following firm trucks were inspected:

3. The tanks appeared to be structurally sound and bolted to the frame. 4. Valves and access ports appeared to be secure. Caps were present on the access ports. 5. The trucks were properly marked in accordance with the lettering requirements. 6. A leak was observed from the outlet valve. North Carolina regulations require all valves to be in good working order and not leaking.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

7. This vehicle has been in operation since December 2019.
