David Powell, Solid Waste Section met Bo Frizzell to follow up on Notice of Continuing Violation corrective actions. Mr. Frizzell was onsite and walked EOW with David Powell. Laser Range finder was used to measure footage of each side of the NLCID and get more accurate than previous measurements. The 4 sides measured as follows: Side 1 south side 291 ft; Side 2 east side 252 ft; Side 3 north side 279 ft; Side 4 west side 309 ft; These measurements may be off slightly but show the size is less than what was previously figured. Although the entire 2-acre footprint is not being used for disposal of waste, the markers should measure ~ 296 ft or less on each side for a total of 2 acres. The total disposal area for the Notified LCID is to remain under two acres in size. 2. Property line buffer of 100 feet was measured and determined to be ~ 111 ft from EOW line established between the two markers. Inspector measured from new markers installed by owner for reference. Area near roadway that had waste a little closer has had waste pushed back, sloped and graded. Be sure the waste doesn’t slowly move its way back over to this buffer as you build the NLCIDLF. Good job. Looking East from property line to NW corner of NLCID. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Along western side of NLCID, near were road reaches top of NLCID and from that point on north, there was still some waste, although covered, outside of EOW marker and still inside the 100 ft. buffer. Mr. Frizzell and some of his staff used onsite equipment to move this additional material to meet buffer and EOW markers while inspector was still onsite. Good job and thank you. Some unapproved items were removed. Some vegetative material in this area along property line is from natural vegetation grown over years and now uprooted from Mr. Frizzells’ corrective actions with heavy equipment in the area. At the time of this inspection, some of the side slopes for the LF appeared to be less than 3:1 in some areas. Soil has been added to cover exposed waste, measures must be taken to establish ground cover sufficient to restrain erosion. The top also is a little flat and may cause water to be impounded over waste which would be a violation. There is also an area on south side which flattened out about halfway up where green vegetation meets fresh orange soil in below picture that may retain storm water. Mr. Frizzell put staff working on this area before inspector left site. Good job. Atop NLCID LF. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 5 of 7 Soil added and being grade. More soil needed for “shelf flat area” which may retain water. 5. Industrial wood chip wastes only have a corn starch added in the pellet process according to the emails, documentation and SDS sheets provided. Wood chip waste is not to be disposed of into the NLCID waste in the future. Mr. Frizzell responded, “No problem with that.” 6. Mr. Frizzell inquired about enlarging the NLCID to a larger permitted site and also starting a grinding operation on same site. David Powell requested that Mr. Frizzell send an email request for what he wanted, describe in detail his plans, so it could be forwarded to get an answer. Information on waste type, source, onsite operations and where material is going is needed to determine what type of process may can be approved. He was put in touch with Ming Chao Permitting Engineer for this county. Mr. Frizzell was also sent the new draft LCID rules. These rules were adopted and approved starting 1/1/2021. Please reach back out to Ming and myself if you wish to pursue this possible grinding operation and permitting the NLCIDLF. 7. Area to the right once reach NLCID LF previously had C and D material dumped but has been removed and weigh ticket provided. However, there is some clean brick and block, not much, still present being used as beneficial fill. This area doesn’t seem to have been excavated and Mr. Frizzell indicated it was much older and had been there long time. Clean brick and block cannot be used as fill in excavated areas so be mindful with this rule in future. Waste cannot be disposed of in water either. This site cannot be used for disposal of C and D materials and is not permitted for such use. A copy of the Beneficial Fill rule 15A NCAC 13B .0562 was emailed to Mr. Frizzell on 12/8/2020. DEMLR and DWR were notified of Mr. Frizzell’s plans to bring soil from offsite to site and fill in previously mined and other wet areas. Be mindful in future to not let facility get out of hand. Scotland County SW may have further requirements needed by the facility. 9. One of the final corrective actions that was needed was documentation of the wood chip waste being removed from staging area. This is across entrance road from NLCID LF. Upon inspection there was still some residual left that could be cleaned up better. Mr. Powell reached back out to Mr. Frizzell after the inspection and asked him to remove this to the NLCID LF and cover appropriately, and provide some pictures. Mr. Frizzell indicated he would do so, and the inspection was withheld by Mr. Powell pending this documentation. Upon 1/11/2020, Mr. Powell received the weight tickets and pictures of the material being cleaned up. 1/12/2021 Mr. Frizzell provided a picture of the area after the work. Good job and thank you. Please continue to stay on top of the issues which cause noncompliance in the future.
