PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: N/a OBSERVED VIOLATIONS: 15A NCAC 13B .0201 states in part: “(a) No person shall treat, process, store, or dispose of solid waste or arrange for the treatment, processing, storage, or disposal of solid waste except at a solid waste management facility permitted by the Division for such activity, except as provided in G.S. 130A-294(b). (c) No solid waste management facility shall be established, operated, maintained, constructed, expanded, or modified without a currently valid permit issued by the Division for the specified type of disposal activity. It is the responsibility of every owner and operator of a proposed solid waste management facility to apply for a permit for the facility. The term "owner" shall include record owners of the land where the facility is located or proposed to be located and holders of any FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 4 leasehold interest, however denominated, in any part of the land or structures where the facility is located or proposed to be located.” ADDITIONAL COMMENTS 1. Section staff inspected this site due to waste being seen from access road to illegal site at rear of property IS262002, also Donald Raynor, for dumping same concrete waste into Little River. Solid Waste Section records indicate this landfill facility was closed in 2008. Further, landfills authorized under 15A NCAC 13B .0563 are not transferrable with the sale of the property. Cumberland County records indicate that the property containing the landfill was sold in 2000, thus making the original notification filed by Bobby Godwin, former property owner, invalid. There are no records with the Register of Deeds that a new permit or authorization was ever issued. As such, this facility cannot be operated for the purposes of fill or disposal with approval of the Division of Waste Management. 2. Concrete blocks, as well as other C and D waste (painted concrete and block, cloth, metal plastic and dimensional lumber etc.) is comingled and deposited along west side, inside tree line and wetland area, of the closed NLCIDLF (Notified Land Clearing and Inert Debris Landfill). Concrete blocks covered and dumped over into low wetland area. Some are buried along this woods line, looking North. Closed NCLIDLF footprint to right of this picture. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. All waste visible on the surface of the ground and partially buried must be removed from the property for proper disposal at a facility permitted by the Division to receive said waste type(s). During site visit Mr. Raynor requested an extension to due date for compliance. The agreed too date was end of January 2021.
