PURPOSE OF SITE VISIT: Partial compliance inspection and compliant investigation: on December 21, 2020 Davy Conners received a complaint that alleged South Wake is running an MSW landfill on the weekends with no certified (MOLD) Landfill Operator and is not properly covering the waste every night. STATUS OF PAST NOTED VIOLATIONS: None OBSERVED VIOLATIONS: None Page 1 of 4 NORTH CAR()LINAD_E Q�� OepaNnent of Envieonmenbl Wel� FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS The facility is an MSW landfill owned by Wake County and operated by Wake County Disposal, LLC. Wake County Disposal is a subsidiary of Waste Industries, Inc. The service area for the facility is Wake County and the municipalities in Wake County. Life -of -Site Permit to Construct (PTC) Phase 2 and Permit to Operate (PTO) Phases IA, 1B, and 2A was issued December 15, 2017. 1. The facility is fenced and is secured by a locking gate when it is not open for operation. The correct signage is at the entrance of the facility listing the facility name, permit number and emergency contact information as well as materials accepted at the facility. The facility accepts waste Monday through Saturday from 7:00am until 4:00pm and is closed Sundays. 2. A complaint was received by the Solid Waste Section about South Wake facility operating on the weekends without a trained facility operator on -site. The facility operator must complete an approved operator training course in compliance with NCGS 130A-309.25. A responsible individual certified in landfill operations must be on -site during all operating hours of the facility at all times while open for public use to ensure compliance with operational requirements. During the inspection, the following SWANA Certified Landfill Operations Specialist certifications were reviewed: • Allan Sinanan, LF-2017006; exp: February 28, 2020 During the inspection, the following SWANA Certified Manager of Landfill Operations certifications were reviewed: • George Moot, Cert. No. 1169654; exp: June 10, 2022 • Seth C. Gundersen, Cert. No. 1531434; exp June 27, 2021 According to Mr. Gundersen, George Moot and Allan Sinanan rotate every other Saturday. After the inspection, Mr. Gundersen emailed Ms. Conners the SWANA Certified Landfill Operations Specialist certification of Michael Heffren who also works the opposite Saturdays of George Moot. • Michael Heffren; LF-20200003; exp February 26, 2023 I recommend that Mr. Sinanan renew his SWANA certification as soon as possible. Based on this information, South Wake is in compliance with this requirement. 3. The complaint alleged that the South Wake facility was not properly covering the waste every night. During the inspection, Ms. Conners reviewed alternative daily cover logs for the month of December. There were a couple of days that did not have written documentation, however, South Wake staff provided Ms. Conners with digitally timed stamped photos of soil and alternative daily cover for those days that were missing records. Digital photos of soil and alternative daily cover are provided to Wake County at the close of busines each night. As of the December 22, 2020 inspection, South Wake is in compliance with this requirement. 4. During the inspection, several areas of the landfill cover had been disturbed by the installation of landfill gas monitoring wells. These areas were collecting water that was impounding over waste. As soon as the weather is dry enough to work in these areas, regrade to promote positive drainage of surface water. Two areas were observed with small erosion rills: below the landfill road where the guard rail stops and above the landfill road near the top. Repair these areas with soil cover, and as soon as possible stabilize with mulch, vegetation, or other stabilizing methods. 6. Windblown waste was minimal and mechanisms such as fencing was in place to reduce windblown waste. Good j ob. 7. During the inspection, there was one small area of exposed waste on the landfill, outside the working face. This area was near one of the new landfill gas monitoring wells. Repair this area and cover with soil.
