15A NCAC 13B .0566 OPERATIONAL REQ. FOR LAND CLEARING/INERT DEBRIS (LCID) LANDFILLS

The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS:
1 - This Notified Land Clearing and Inert Debris Site (LCID - N0321) has a Yard Waste Notified Site (YWN 27-002) and a Temporary Disaster Debris Site (DS-27-013) located on same tract of land. 2 - The LCID Site has an Air Curtain Burner (ACB) to dispose of the waste. 3 - Roads are constructed of all-weather materials (gravel & sand) and is being maintained in good condition. 4 - Entrance road has locking cable/chain and signage has been replaced. 5 - No setback issues noted during this inspection.
6 - The LCID waste piles are getting fairly large. Need to start removing through the use of the ACB and/or grinding as mulch to remove from this site. 7 - Some waste has been burned as the trench box was smoldering.
8 - OBSERVED VIOLATION: 15A NCAC 13B .0566 OPERATIONAL REQ. FOR LAND CLEARING/INERT DEBRIS
(LCID) LANDFILLS; 2) The facility shall only accept those solid wastes which it is permitted to receive.
9 - There was Construction and Demolition Debris (C&D) noted that has been hauled in and placed by the
concrete storage area. THIS MUST BE REMOVED AND TAKEN TO A PERMITTED FACILITY. THERE ARE 2 FACILITIES CLOSE TO YOUR FACILITY THAT ARE PERMITTED TO RECEIVE THIS WASTE. 10 - A FOLLOW UP INSPECTION WILL BE CONDUCTED TO ENSURE THIS WASTE HAS BEEN REMOVED AND TAKEN TO A PERMITTED FACILITY. KEEP THE RECEIPTS FROM THE FACILITY. THESE RECEIPTS WILL BE ASK FOR DURING THE FOLLOW UP INSPECTION. 11 - A NOTICE OF VIOLATION WILL BE ISSUED TO YOUR FACILITY IF THE ABOVE ITEM HAS NOT BEEN CORRECTED. A FOLLOW UP INSPECTION WILL BE CONDUCTED AROUND 30 DAYS OF THIS REPORT TO ENSURE COMPLIANCE MEASURES HAVE BEEN TAKEN. 12 - As for the Inert Debris (Concrete), you are stockpiling this material too long. No grinding has taken place now for several years. 13 - You will be able to reuse or sell this Inert Debris. 14 - Need to put setback markers up.
