STATUS OF PERMIT:
A Land Clearing and Inert Debris Notification was recorded with the Iredell County Register of Deeds on May 1, 2019
by Bradley Mills.
PURPOSE OF SITE VISIT:
Comprehensive inspection and complaint investigation.
STATUS OF PAST NOTED VIOLATIONS:
None
OBSERVED VIOLATIONS:
A. CORRECTIVE ACTION IN PROGRESS: 15A North Carolina Administrative Code 13B .0566(4) states:
`Adequate soil cover shall be applied monthly, or when the active area reaches one acre in size, whichever occurs
first.
During the inspection conducted on December 18, 2020, smoke was observed escaping through vents and exposed waste
on the northern side slope. Facility staff had not applied adequate soil cover on the landfill to completely cover the waste
and to prevent the combustion of the wood waste. As a result, Amity Hill LCID, LLC is in violation of 15A NCAC 13B
.0566(4).

During the inspection conducted on December 22, 2020, minimal smoke was escaping through exposed waste on the
northern side slope. Facility staff was actively applying soil cover to the side slope and stated they will continue until the
exposed waste is completely covered with soil.
To achieve compliance, all waste shall be covered with adequate soil cover and compacted. Adequate soil must be
placed over the waste to ensure that the fire is extinguished. Immediately discontinue acceptance of waste until
the fire has been completely extinguished. Notify the Division once the fire has been extinguished and it is
deemed safe to work within the landfill area. By January 8, 2021, cover the entire waste area with adequate soil,
including the working face and side slopes, as required by 15A N.C.A.0 13B .0566(4).

B. 15A North Carolina Administrative Code 13B .0566(12) states: "Open burning of solid waste is prohibited. "
During the inspection conducted on December 18, 2020, the waste within the landfill was on fire. This is a violation of
15A N.C.A.0 13B .0566(12). On December 22, 2020 a significant amount of soil had been added to the northern side
slope, however, a small amount of smoke was still visible at the toe of the slope.
To achieve compliance, actions must continue to ensure that the fire is completely extinguished. Immediately
discontinue acceptance of waste until the fire has been completely extinguished. Notify the Division once the fire
has been extinguished and it is deemed safe to work within the landfill area. By January 8, 2021, cover the entire
waste area with adequate soil, including the working face and side slopes, as required by 15A N.C.A.0 13B
.0566(4).
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. This facility is a Land Clearing and Inert Debris landfill for the disposal of land clearing waste, inert debris,
untreated wood, and yard trash requiring a disposal area of less than two acres.
2. Mr. Mills and Mr. Swartz were on -site December 12, 2020 after spotting smoke and immediately started applying
soil cover to the smoldering debris.
3. On December 13, 2020, Wayside Volunteer Fire Department responded after receiving a complaint of burning at
the facility. Upon arrival, facility staff were on -site covering a smoldering pile of debris with soil and the fire
department deemed the site under control.
4. The inspection conducted on December 18, 2020 was to follow-up on a complaint received on December 15, 2020
reporting a fire at the facility on December 12, 2020.
5. At the time of the inspection conducted on December 18, 2020 facility staff had applied soil cover to the smoldering
debris and were continuing to apply soil cover to exposed waste on the northern side slope. Adequate soil cover had
not been applied to the northern side slope (see observed violations section of this report).
6. Smoke was observed escaping through vents and exposed waste on the northern side slope.
7. During the inspection conducted on December 18, 2020, no open flames were observed in the landfill.
8. During the inspection conducted on December 22, 2020, a slight smoke odor was detected at the toe of the northern
slope next to the erosion sediment pond. No odor was detected on top of the landfill.
9. 15A North Carolina Administrative Code 13B .0566(3) states: "Solid Waste shall be restricted to the smallest area
feasible and compacted as densely as practical into cells. " Ensure that waste is properly compacted and that side
slopes are not too steep so adequate cover can be applied as per 15A NCAC 13B .0566(4).
10. Access to the site is secured by a gate to prevent unauthorized access except when a site attendant is on duty.
It. Ensure permanent edge of waste markers that accurately designate the waste disposal boundary are installed
and maintained at the facility.
