STATUS OF PERMIT:
In 1973. Landfill operations began in Phase 1 on this property. Facility permit 51-03 is a combination of facility permits
51-01 and 51-02.
Permit to Construct Johnston County MSW Landfill, Phase 6 issued May 8, 2020.
Permit to Operate 5103-MSWLF Phase 4A and 5103-CDLF Area 2 Cells 1 and 2 issued May 8, 2020.
Permit for Closure for MSW Phases 1 through 4 and C&D Area 1 issued May 8, 2020.
Life of Site Permit for 5103-MSWLF and 5103-CDLF issued May 8, 2020 and will expire August 8, 2057.

The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS
On November 13, 2020, Mr. Proctor called Amanda Thompson to report how the landfill fared during the heavy
rain on November 12, 2020. Mr. Proctor stated that the landfill had received almost 7 inches of rain within a two-
hour period. The MSWLF had lost approximately 90% of cover and waste was exposed. Mr. Proctor also stated
that some of the exposed waste was washed into the drainage ditches; however, no waste left the site. Mr. Proctor
said that the staff was working on covering the waste as quickly as possible. Final sloping and grading would take
place after the ground dried out. Ms. Thompson scheduled the follow-up inspection with Mr. Proctor for Tuesday,
November 17, 2020.
1. The facility is fenced and is secured by a locking gate when it is not open for operation.
2. The correct signage is at the entrance of the facility listing the facility name, permit number and emergency contact
information as well as materials accepted at the facility.
3. The facility accepts waste Monday through Saturday from 8:00 am until 4:45 pm and closed on Sunday.
4. The permit, and operations plan, and records were not reviewed during this inspection.
5. The landfills had no woody vegetation and were mowed.
6. Permanent edge of waste (EOW) markers were in place and being maintained.
7. The perimeter road is being well maintained.
MSWLF
8. Mr. Proctor had pointed to the berm near the top of the MSWLF and explained that the berm had failed in one
location and nearly failed in a second location. An area of exposed MSW waste was observed near the southwestern
corner of the side slope, near the berm failure. The area was in the process of being covered and graded.
9. Landfill staff were also actively removing waste and sediment from the drainage ditch at the base of the southern
slope. Mr. Proctor stated that a portion of the southern slope had been covered and reiterated that the landfill had
lost approximately 90% of the soil cover.
10. At the top of the landfill, some exposed waste and equipment tracks were observed. Mr. Proctor stated that the top
of the landfill would be properly graded and covered as the area dries.
11. The working face at the MSWLF appears to be kept small and appeared to be well compacted with no unacceptable
wastes observed. Several loads of cover dirt were delivered to the working face during the inspection.
12. No leachate releases were observed during this inspection.
CDLF Area 1
13. Mr. Proctor stated that the CDLF Area 1 should be closed within the next week or so. The proper closure
paperwork will be submitted to the Section for review once complete.
14. Any C&D waste received at the landfill is being disposed of in the MSWLF.
15. Numerous erosion rills were observed along the side slopes of CDLF Area 1 and were in the process of being
repaired and graded.
Yard Waste
16. The yard waste was properly windrowed within the processing area.
17. Water was observed between the windrows in the northern portion of the yard waste processing area. Mr. Proctor
stated that the yard waste area would be graded and repaired once the yard waste was processed and ground. It
was recommended that measures begin to address the standing water in the yard waste area.
18. Mr. Proctor also stated that the grinding contractor was behind schedule and would not be at the site until

19. No unacceptable waste was observed within the waste stream. Landfill staff were in the yard waste processing
area when yard waste loads were dumped.
MSWLF Phase 6
20. The MSWLF Phase 6 is currently under construction. At the time of this inspection, the area was being graded and
soil compacted in lifts to obtain the proper separation from the seasonal high groundwater table.
21. Corrective measures are necessary as a result of this inspection.
