The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS: 01 – This LCID facility segregates the material and recycles / reuses most of this waste. 02 – The large land clearing material is ground/chipped and sold as boiler fuel with some cut as firewood.
03 – The small land clearing material is put into the landfill and covered. 04 – The inert debris (concrete) is ground and sold and some is sold and reused like rip rap for erosion control. 05 – Some of the concrete / brick will be placed into the landfill if needed. 06 – There is a pile of scrap tires located outside of the landfill footprint. E&M Contracting uses these tires to protect sidewalks and roads during demolition of buildings around several cities and towns.
07 – Facility has locking gate with STOP signage. Need to add additional signage at landfill entrance with Emergency Contact name and number as stated in rule; 15A NCAC 13B .0566 OPERATIONAL REQ. FOR LAND
CLEARING/INERT DEBRIS (LCID) LANDFILLS #16. A copy of this rule was discussed with and given to Mr. Smith during this inspection. Facility Number is not required at this time, but can be placed on sign if owner wants too. 08 – Facility has adequate cover onsite and has been covering landfill monthly at a minimal.
09 – Overall management of this facility appears to be in compliance. 10 – Digital pictures were not taken during this inspection.
