PURPOSE OF SITE VISIT: Partial Inspection STATUS OF PAST NOTED VIOLATIONS: Long.:-80.231984 A. CORRECTIVE MEASURES IN PROGRESS: 15A NCAC 13B .0203(d) states, `By receiving solid waste at a permitted facility, the permittee shall be considered to have accepted the conditions of the permit and shall comply with the conditions of the permit." Permit to Operate No. 3416T-TRANSFER-, ATTACHMENT 3, PART VI, Transfer Station/Treatment and Processing Unit Condition #7(a) states, "The tipping floor and transfer trailer loading area must be maintained in a clean, sanitary condition at all times and must be cleaned at least daily." New cleaning procedures have been implemented, and temporary patches have been added to the outside wall of the loading bay to prevent waste from escaping the facility. Additional site visits will be required to determine if these methods are effective at achieving and maintaining compliance. CORRECTIVE MEASURES IN PROGRESS: 15A NCAC 13B .0402(6) states, "Equipment shall be provided in the storage and charging areas and elsewhere as needed or as may be required in order to maintain the facility in a sanitary condition." See Violation B above for additional information about corrective actions being undertaken to achieve compliance. OBSERVED VIOLATIONS: No additional violations were observed during this inspection. However, violations listed in the Status of Past Noted Violations section of this report remain unresolved. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS: 1. The purpose of this inspection was to follow up on corrective actions and temporary measures enacted to address existing violations. (See Status of Past Noted Violations section of this report for additional information) 2. Prior to the inspection, Mr. Bouchard had provided copies of the original facility construction drawings via email that show the actual design of the leachate collection system. Rather than trench drains, as had been assumed, the design is based on a 35' long drain centered under the scales that runs parallel to the loading bay walls. Liquids flow through the drain to a 2,000-gallon oil/water separator that is connected to an automatic pump system (equipped with an alarm) that pumps the liquid into the sanitary sewer line. In addition, the plans showed that the two inlets directly outside of the loading bay wall are tied into the leachate collection system rather than the stormwater system, as previously assumed. 3. The loading bay floor drain is recessed, and the concrete floor under the scales is sloped to direct the flow of liquid to the drain. Mr. Bouchard explained that the small gap between the metal plates of the scale and the concrete curbing along both walls of the loading bay was designed to direct liquid and small debris to the drain. In addition to the gap between the scales and the curbing, gaps that run perpendicular to the loading bay walls were created when sections of the metal floor were patched or replaced. It is the areas on the loading bay floor, where these gaps exist and where waste has been allowed to build up, that must be cleared of waste and debris. Cleaning must take place at the end of every operating day in order for the facility to comply with the conditions of the Permit to Operate and with 15A NCAC 13B .0402(6). 4. Mr. Bouchard worked with facility staff using pry bars and shovels to begin to remove the waste that had accumulated in the gap around the scales. Due to the cold temperature, the water hose was not operational at the time of the inspection. Mr. Bouchard provided pictures of some of these areas of concern following the inspection to illustrate the progress that had been made. Additional inspections will be necessary in order to inspect the loading bay and determine if the requirement for the sanitary operation of the transfer station is being met. 5. Since the previous inspection on November 17, 2020, facility staff had installed temporary sheet metal patches on the outside wall of the loading bay to keep waste from leaving the building. Mr. Bouchard stated that plans were in the works to replace the entire exterior wall of the building, although he was unsure as to the timeline for the project. 6. Mr. Bouchard stated that the required modifications to the current Operations Plan were still being finalized. He explained that, although he had hoped to submit them before the Thanksgiving holiday, he anticipated that they would be ready by mid -December. The modifications will include the addition of the Great Oak Landfill (Permit # 7607) as an approved disposal facility as well as the new procedures for inspecting trailers.
