PURPOSE OF SITE VISIT:
Partial Inspection
STATUS OF PAST NOTED VIOLATIONS:
A. CORRECTIVE MEASURES IN PROGRESS: 15A NCAC 13B .0201(c) states, in part: "No solid waste
management facility shall be established, operated, maintained, constructed, expanded, or modified without a
currently valid permit issued by the Division for the specified type of disposal activity." This aspect of corrective
actions was not observed during this inspection.
B. CORRECTIVE MEASURES IN PROGRESS: 15A NCAC 13B .0203(d) states: `By receiving solid waste at a
permitted facility, the permittee(s) shall be considered to have accepted the conditions of the permit and shall

comply with the conditions of the permit." Permit to Operate No. 3424, ATTACHMENT 1, PART I: GENERAL
PERMIT, general permit condition 6 states, in part, "Operation of this solid waste management facility shall be in
accordance with the Solid Waste Management Rules, 15A NCAC 1313, Article 9 of the Chapter 130A of the North
Carolina General Statutes (NCGS 130A-290, et seq.), the conditions contained in this permit, and the approved
plan." Permit to Operate No. 3424, ATTACHMENT 1, PART VI, TRANSFER STATION/TREATMENT &
PROCESSING UNIT(S), List of Documents for Approved Plan, includes the Operations Manual, December 31,
2015 (DIN 25646). Section 2.8 of the approved Operations Manual (December 31, 2015), Processing Area Legend,
indicates that the preferred location for aging trommel-overs is the South Site. This aspect of corrective actions
was not observed during this inspection.
OBSERVED VIOLATIONS:
No new violations were observed during this inspection. Corrective measures are still in progress, as noted above in
the Summary of Past Noted Violations section of this report.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS
1. The sole purpose of this inspection was to investigate reports of smoke and possible fire in the processed wood
waste stockpile on the leased site.
2. Facility access roadways are of all-weather construction and maintained in good condition, so the wood waste
operations area on the leased site was easily accessible by vehicle. The stockpile of wood waste is located south
of a pile of clean wood pallets waiting to be ground.
3. Steam was visible at several spots in the pile. No smell of burning wood was evident during the inspection.
4. The stockpile was approachable only on the eastern side, and one vent where steam was escaping was observed
at close range. No smoldering materials or flames were visible in the vent itself, and the surface of the stockpile
was not hot to the touch.
5. Following the inspection of the wood waste stockpile, a facility staff member (Mickey) indicated that the steam
or smoke had started to become evident over the past several weeks. He added that staff checked on the pile
several times a day and, if necessary, opened it up to help dissipate the heat that had built up. He also stated that
the fire department had been to the site twice to investigate as well but had found no fire on either occasion.
6. During a phone conversation with Ronnie Petty following the inspection, Mr. Petty stated that he had been
monitoring the site, especially after operating hours and on weekends, to ensure that the pile wasn't burning.
Mr. Petty made assurances that he would continue to watch the situation closely.
7. In a subsequent phone call on December 7, 2020, Mr. Petty stated that he was assembling a crew to work on the
site on December 8, 2020. His explained that he intends to tear down the pile and form it into a series of small
windrows that could be easily turned or spread out as needed to address temperature increases. Please continue
to provide updates as to the status of the processed wood waste and progress made in removing it from
the site.
8. Open burning of solid waste is prohibited, as stated in General Permit Condition 6 of permit # 3424-
TRANSFER-2010.
9. Should fire occur, it must be reported within 24 hours of the occurrence to: Susan Heim, Environmental
Senior Specialist, at 336-776-9672 or via email at susan.heim(&ncdenr.gov. The fire must also be reported
within 15 days of occurrence using the prescribed fire notification form found online at
httus:Hdeci.nc.2ov/about/divisions/waste-management/solid-waste-section/solid-waste-forms.
