STATUS OF PERMIT:
A Permit to Operate Greenway Waste Solutions of Apex, LLC, permit numbers 9230-CDLF-2014 (Phase 1, 2, and 3)
and 9230-COMPOST (Large Type 1), was issued on July 10, 2020 and February 21, 2020, respectively, and will expire
on December 10, 2062 and February 21, 2030, respectively.
PURPOSE OF SITE VISIT:
Partial compliance inspection and disaster debris site evaluation.

The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS
The facility is a privately owned construction and demolition (C&D) landfill and large type 1 composting facility. The
facility is permitted to receive C&D waste, inert debris, land -clearing debris, and asphalt generated within Wake County.
The CDLF is approved to accept approximately 300,000 tons per year in accordance with the approved 20 year franchise
granted by Wake County dated November 19, 2001 (FID 98996). The capacity of the compost site is approximately
20,000 tons per year.
1. The facility is secured by locking gate and fence when it is not in operation. The operating hours are Monday
through Friday, 7 am to 5 pm, and Saturday 7 am to 12 pm. Signs are posted at the facility entrance listing that
state types of waste that can and cannot be received at the facility, the hours of operation, the permit number(s),
contact name, telephone number, and other pertinent information.
2. During the inspection, construction and demolition waste was observed on the inactive CDLF cell and the
finished compost pile, that had been erroneously dumped in the wrong location. Additional signage, traffic
cones, attendees, etc. might be necessary to prevent and deter improper dumping.
3. Interior roadways are of all-weather construction and maintained in good condition.
4. Land clearing debris is stockpiled onsite to be ground for mulch on the side slopes of the inactive CDLF as a
vegetative stabilization layer. Concrete and asphalt are stockpiled onsite and ground periodically.
5. Surface water was ponding near the composting windrows. When weather permits, regrade the compost
operational area to promote drainage of surface water.
6. A very small amount of water was ponding on top of the inactive CDLF. On November 2, 2020, Grant Kiser
emailed Davy Conners photo evidence of repairs made this area (Attachment 2). Good job.
7. Two leachate seeps were observed along the side slopes of the inactive CDLF cell. Mr. Kiser was aware of
these seeps and had previously made repairs to the landfill to try to correct them. On November 2, 2020, Mr.
Kiser emailed Ms. Conners photo evidence of repairs made these areas. Please continue to monitor these
areas for leachate seeps.
8. Greenway Waste staff was observed picking up windblown waste during the inspection, however some
windblown waste was seen on the side slopes of the inactive CDLF. This waste was immediately picked up by
Mr. Kiser and Mr. Kayser.
9. A small erosion rill was present at the top of the inactive CDLF. On November 2, 2020, Mr. Kiser emailed Ms.
Conners photo evidence of repairs made this area. Good job.
