This permit to operate a Septage Management Firm is issued to the above named person, business or entity alone and is not transferable to any other person, business or entity. Firm operation shall be in accordance with the provisions of N.C. General Statute 130A-291.1 - 130A-291.3, Title 15A of the N.C. Administrative Code 13B .0800 et.seq., conditions of the permit, and representations made in the application and accompanying documents for a permit. The permit holder is authorized to discharge septage only at the locations(s) listed below: 1. Please note that the effective date of eaclr Permit will be April 30, 2020. If you have ally comments concerning this Pennit, please notify this office in writing no later than thirty (30) days following receipt of this letter. METROPOLITAN SEWERAGE DISTzuCT OF BIINCOMBE COUNTY, NORTH CAROLINA Edwards r of Operations and Pretreatment PART I GENERAL CONDITIONS & REOUIREMENTS Permit No.'46 A. Permits - By Filing an Application for Permit to Discharge, each Permit Holder agrees to abide by the provisions of the MSD Sewer Use Ordinance, North Carolina General Statutes 143.215.1 et seq. and any conditions or regulations established by MSD, the State or Federal Government. B. The truck for which this Permit is issued shall prominently display the Permit Number on both sides of the vehicle. C. MSD has a designated septage receiving station at the MSD Wastewater Treatment Plant, at 2110 Riverside Drive, where septage may be discharged. The discharge of septage atany place other than the designated receiving station is strictly prohibited. D. MSD will accept residential septage from Buncombe, Haywood, Henderson, Madison, McDowell, Mitchell, Polk, Rutherford, Transylvania and Yancey Counties. The MSD may consider accepting septage from other counties, provided, however such septage will not be accepted until the Wastewater Hauler makes a written request to the MSD, and the request has been approved with a Special One Time Discharge Permit. A separate Permit must be secured for each such discharge. MSD may require laboratory analysis of the waste and the Wastewater Hauler shall pay for the analysis. E. This Permit is only for the discharge of septage from residential units and/or port-a-jons. Waste from commercial or industrial establishments may not be discharged pursuant to this Permit. Such wastes prohibited from being discharged into the MSD system include, but are not limited to the following; (a) food service grease trap wastes; (b) pumping from sandlorllwater separators; (c) toxic or hazardous wastes; (d) sludge and/or grit from publicly owned wastewater treatment plants or lagoons. F. MSD will accept sludge fi'om a privately owned package plant within the counties listed in Item D. This material will be charged at the same rate as septage. G. The discharge of any hazardous substance, as that term is defined in the North Carolina Oil Pollution andlfazardous Substance Control Act, G. 5.143-215.75 et seq. or any material which MSD determines is harmful to the operation of the MSD sewerage system, is strictly prohibited. H. Septage must be discharged between the hours of 7:00 a.m. and 7:00 p.m., Monday through Saturday at the septage receiving station. Ifa need arises to discharge after these hours, each case will be handled on an individual basis. Permit Holders are required to maintain the dumpsite by keeping it clean and insure all septage is properly discharged to the sewer. I. PART I GENERAL CONDITIONS & REQUIREMENTS Permit No. 46 Permit holders shall provide accurate and complete information as to the origin and contents of each load of septage discharged into the receiving station, upon request. This information is to be presented to MSD at the time of discharge. It must consist of the following: 1 Name of the homeowner 2 Location/address 3 City 4 Zip Code5 County 6 Homeowner's telephone number7 Date the waste was collected The General-Manager or his designee may disallow the discharge of any septage into the receiving station. If the General Manager or his designee determines that the discharge is in violation of Norlh Carolina General Statutes 143-215.1 et seq., the Sewer Use Ordinance, Pennit condition, or is injurious of harmful to the operation of the Wastewater Treatment Plant or the safety of MSD Personnel. Spot checks and laboratory analysis of septage will be made at the discretion of MSD. MSD reserves the right to require septage haulers to sample and analyze septage by a commercial laboratory prior to discharge. The cost of sampling and analysis shall be paid by the Permit holder. This Permit may be suspended or revoked immediately by MSD for a violation of any provision of North Carolina General Statutes 143-215.1 et seq., the MSD Sewer Use Ordinance, the Permit, pretreatment regulations, conditions, limitations, or other regulation established by MSD. In addition, MSD may levy and collect civil penalties and take enforcement action, as it deems necessary, including the publication of the Permit's holder's name, address and statement in a local newspaper. MSD shall also have the right to recover any cost of enforcement including reasonable attorney's fees. North Carolina General Statutes 143-215.6 A O authorizes MSD to collect civil penalties of up to $ 25,000 per day for any Permit violation. Each day a violation continues may be treated as a separate violation. Rates and Charges. Permit holders shall pay prevailing rates and fees for discharge of septage. Failure to pay any rates or fees shall be grounds for revocation of this Permit. Sampling and testing for these parameters will be periodically performed by the MSD.
