STATUS OF PERMIT:
A Land Clearing and Inert Debris Landfill Notification was recorded with the Iredell County Register of Deeds on July
28, 2016 by Shane and Melody Hildebrand, property owners.
PURPOSE OF SITE VISIT:
Comprehensive Inspection
STATUS OF PAST NOTED VIOLATIONS:
None
OBSERVED VIOLATIONS:
1. RESOLVED: 15A NCAC 13B .0566(2) states: "The facility shall only accept those solid wastes which it is
permitted to receive. "
During the inspection conducted on November 23, 2020, municipal solid waste was observed at the facility. As a result,
Checkered Flag Land & Cattle is in violation of 15A NCAC 13B .0566(2).
To achieve compliance, Checkered Flag Land & Cattle, must remove all unacceptable solid waste from the site, including
any that may be buried, and properly dispose of it in a facility permitted by the Division of Waste Management. Proof of
disposal must be submitted to the Solid Waste Section in the form of disposal receipts indicating the facility where the
waste was disposed. Receipts for disposal of all the waste should be sent to:

During the inspection conducted on December 2, 2020, facility staff had removed all the municipal solid waste observed
on November 23, 2020. The solid waste was disposed at Iredell County Landfill on November 25, 2020 and facility staff
provided the disposal ticket. Therefore, this violation is considered resolved.

2. RESOLVED: 15A NCAC 13B .0563(1)(b) states: "The total disposal area is under two acres in size. "
During the inspection conducted on November 23, 2020, land clearing waste was observed in an area Southwest of the
active landfill and outside of the two -acre boundary. As a result, Checkered Flag Land & Cattle is in violation of 15A
NCAC 13B .0563(1)(b).
To achieve compliance, Checkered Flag Land & Cattle, must remove all land clearing waste in this area and properly
dispose it in the approved land clearing landfill area.

During the inspection conducted on December 2, 2020, facility staff had removed all the land clearing waste observed in
this area on November 23, 2020. Therefore, this violation is considered resolved.
3. CORRECTIVE ACTION IN PROGRESS: 15A NCAC 13B .0566(4) states: `Adequate soil cover shall be applied
monthly, or when the active area reaches one acre in size, whichever occurs first. "
During the inspection conducted on November 23, 2020, waste was exposed along the northern slope of the landfill and at
toe of the slope south of the erosion control pond. As a result, Checkered Flag Land & Cattle is in violation of 15A
NCAC 13B .0566(4).
During the inspection conducted on December 2, 2020, facility staff had relocated some of the exposed land clearing
debris to the top of the slope and adequate cover was applied. Due to the recent wet weather facility staff is in the process
of relocating the exposed land clearing debris to the top of the slope and covering with adequate soil cover.
To achieve compliance, by December 18, 2020, Checkered Flag Land & Cattle, must apply adequate soil to all waste
including side slopes.

The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS
1. The facility is a Land Clearing and Inert Debris Landfill Notification site which is permitted to accept only land
clearing waste, inert debris, untreated wood and yard trash.
2. Proper signage was observed at the entrance of the facility.
3. Access roads are of all-weather construction and in good condition.
4. Access to the site is secured by a gate to prevent unauthorized access except when an operator is on duty.
5. No surface water was observed ponded around waste.
6. All timber stock piled for personal milling on the landfill should be relocated to an area outside the foot print
of the active landfill.
7. Ensure permanent edge of waste markers that accurately designate the waste disposal boundary are installed
and maintained at the facility.
