STATUS OF PERMIT:
Yard Waste Facility Notification application received by Solid Waste Section for the first time on November 18, 2019. Yard Waste Facility Notification expires on June 1st each year PURPOSE OF SITE VISIT:

The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
On November 12, 2020, Chuck Kirchner conducted a comprehensive inspection of the David Blackwell Farm #2 YWN off Vaughn Road in Burlington, Alamance County. 1. The yard waste notification (YWN) is located at 1340 Vaughn Road in Burlington which is property owned by David Blackwell. 2. The site is a property owned by Mr. Blackwell and leaf debris is collected and composted to be used on his own property according to Mr. Blackwell.
3. This site has not been used since before June 1, 2020 according to Mr. Blackwell. 4. No composted material is sold to the public according to Mr. Blackwell. 5. The designated area used for the YWN is less than 2 acres. 6. The Solid Waste Section must receive your yard waste facility notification renewal form by June 1st of each year prior to storing materials on site. If your facility only processes and stores less than
6,000 cubic yards of the following materials on a quarterly basis, you can continue to operate by notifying the Section on an annual basis by June 1st of each year. A permit is required prior to processing and storing over 6,000 yards per quarter or expanding the facility greater than 2 acres in size. If you plan to increase composting activities to more than 6,000 cubic yards quarterly or exceed
2 acres in size please contact the Solid Waste Section for assistance in obtaining a permit. Persons
receiving no more than 30 cubic yards of leaves from an offsite source on an annual basis are exempt and do not need to submit an annual notification. 7. 8. Material must be processed and removed from the site on a regular basis, so that 75 percent, by weight or volume, of material is removed within a calendar year of receipt. In other words, Yard Waste Notification sites are not approved for permanent storage or final disposal. Facilities are required to track incoming/outgoing volumes and provide the information to the Division of Waste
Management upon request to verify compliance.
9. Yard Waste Notification sites are required to track incoming and outgoing volumes of material and should be able to provide estimates of material on site and throughput numbers upon request. 10. The YWN site is open to the public. 11. Facilities operating under notification shall only receive: a. Untreated and unpainted wood waste.
b. “Silviculture Waste” as defined in 15A NCAC 13B .0101(41); waste materials produced from the care and cultivation of forest trees, including bark and woodchips. c. “Yard Trash” as defined in 15A NCAC 13B .0101(55); solid waste resulting from landscaping and yard maintenance such as brush, grass, tree limbs, and similar vegetative material. d. “Yard Waste” as defined in 15A NCAC 13B .0101(56); yard trash and land clearing debris to
include stumps, limbs, leaves, grass, and untreated wood. 12. Facilities operating under notification are required to operate in accordance with 15 NCAC 13B .1406 and .1404(a)(1)-(10).
13. Mulch was observed to have been previously removed from site during this inspection. 14. Open burning of waste is prohibited.

15. Fires shall be reported to the Division orally within 24 hours of the incident and in writing within 15 days of the incident.
