The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. The lined Phase I MSW landfill (2906-MSWLF-1994) ceased accepting waste on December 16, 2008; the
C&D landfill ceased accepting waste in June 2016.
2. Photos included in this report were taken by Susan Heim on November 16, 2020 unless otherwise noted.
3. The facility monitors groundwater and surface water, and tests leachate semi-annually, as required. The
monitoring system for the Phase 1 closed landfill consists of 13 wells, 3 surface water locations and one
leachate location. The monitoring system for the closed C&D landfill includes 5 downgradient wells plus I
upgradient well that is part of the Phase I system. No surface water or leachate monitoring points exist for the
C&D landfill.
4. The two most recent groundwater monitoring reports were reviewed online and verified after the inspection.
Sampling occurred September 16-20, 2019 and March 9-12, 2020.
5. Landfill gas is monitored quarterly for the closed Phase 1 and C&D landfills, as required.
6. Leachate is pumped and hauled from the landfill to the City of Lexington's wastewater treatment plant for
disposal. The facility records the number of truckloads hauled and matches these records with the city's
monthly billing statements. In this way, the volume of leachate can be cross-checked. Leachate disposal records
for the period January 1 through August 31, 2020 were reviewed. For the month of April, 214,500 gallons were
hauled from the closed Phase I side of the facility.
Field Inspection:
7. The closed Phase 1 landfill was observed to be well -maintained, with vegetative cover fully established and
recently mown. Some woody growth was observed in small patches on the landfill cap and around the toe of the
slope. Please ensure that any woody growth and small trees are removed from the landfill cap, and that
the cap is repaired as necessary to fully restore the integrity of the cap.
8. The closed C&D landfill was also found to be well -maintained with a fully established and recently mown
vegetative cover.
9. No evidence of erosion was observed at either landfill.
10. The rock -lined perimeter drainage ditch surrounding the Phase 1 MSW landfill had been cleaned out and
appeared to be fully functional.
11. Access roadways are of all-weather construction and were observed to be in good condition.
12. The leachate pond was also observed to be well maintained, and the visible portion of the liner appeared to be
intact. More than 2' of freeboard was visible in the pond.
