OBSERVED VIOLATIONS:
1. Rule 15A NCAC 13B .0842(a)(17) & Permit Condition 2 Approved nutrient management plans shall be
followed. This site shall be operated and maintained in accordance with the nutrient management plan submitted
by Maxine and Frankie Jones and approved by the Division of Waste Management. A review of land
applications site logs submitted by Belton’s Septic Tank Service (which covered a time frame of November 2018
thru October 2020) determined that the monthly application rates as per the approved nutrient management plan
and current permit were exceeded on three occasions. Each over application was on a “low” month (as noted in
the nutrient management plan) which allows only 5,000 gallon times the acreage for that field (Field 1=10.4 acres,
Field 2=11.0 acres). The logs showed that 60,400 gallons were applied on Field 1 in December 2019 (exceeding
the rate by 8,400 gallons), that 70,850 were applied on Field 2 in January 2020 (exceeding the rate by 15,850
gallons) and that 71,000 gallons were applied on Field 1 in February 2020 (exceeding the rate by 19,000
gallons). Corrective actions shall be taken by the permit holder to ensure that discharge events and
application rates are monitored throughout each month and thru each year to not exceed the monthly or
yearly application rates (as per the permit and the approved nutrient management plan) for each field and
for the entire site.

ADDITIONAL COMMENTS
1. No site inspection was performed at this time. This violation (for exceeding the monthly application rates) was
discovered during a review of submitted land application site logs. The annual maximum application rate for the
entire site was not exceeded during the time frame covered in these site logs. A permit review is currently under
way for a modification to include a third disposal field/additional acreage to this site.

enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
