PURPOSE OF SITE VISIT: Routine STATUS OF PAST NOTED VIOLATIONS:
Work to remove accumulated haybales noted in the 11/19/2019 and 4/27/2020 audit reports was performed, haybales remained in overgrown areas in the field margins.
OBSERVED VIOLATIONS:
Accumulating old haybales, discarding haybales in buffers and wooded areas on the permitted site is a violation of: Nutrient Management Plan
Section G line 4 Stating, “The bales will be sold to a local farmer or removed off the permitted site”.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS

1. The access roads leading to the disposal area were posted with visible and legible signs stating, “NO
TRESPASSING, SEPTAGE LAND APPLICATION SITE".
2. The roads accessing the site were passable.
3. The disposal area boundaries were discernable from the surrounding landscape.
4. No discharges were noticed outside of the permitted boundaries.
5. Applications appear to be made in accordance with the nutrient management plan.
6. The crop described by the nutrient management plan is present and is being maintained as prescribed. Numerous old and newer hay bales remain in overgrown areas around the perimeter of the fields. Hay bales should be removed from permitted site and not be allowed to accumulate. Old haybales discarded
in wooded areas and buffer areas adjacent to the permitted fields should be removed from the site as
well. 7. No septage applications were made during the site visit.
8. No objectional odors where noticed.
9. Required setbacks appear to be met.
10. Land Application records were not checked.
