PURPOSE OF SITE VISIT: Follow Up Inspection STATUS OF PAST NOTED VIOLATIONS:

OBSERVED VIOLATIONS: NA
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS 1. David Powell conducted a site visit to check the progress made towards addressing issues discussed on previous visits, Notice of Violation and Notice of Continuing Violations.
2. Behind parking area, just inside fence and to the right, seems to be in better condition than last inspection. Although there is still plastic, wire, metal and other misc. items comingled in the rock/soil/block in this area
onsite. Much of the previous C and D material is now gone and no longer onsite. Documentation of where this was taken and disposed needs to be sent to DWM. Below (in top picture), 3 loads of vegetative material were brought in and dumped. Facility is operating while it has been shut down due to compliance issues.
While inspector was onsite, a truck for Dump and Go facility was arriving with another load of vegetative material. Inspector called number onsite and spoke with driver, Ricky Smith, to see if Mr. or Mrs. Gilmore were onsite. He stated they were not onsite. Inspector left message on voicemail.

Waste still comingled in rock/soil/block onsite. C and D removed, provide documentation to DWM.

3. Area between fuel tanks and road to top of closed NLCIDLF has had waste removed and soil spread out.
4. The owners were informed at the time of the last inspection and in the Notice of Violations to process the YW and remove it from top of the closed NLCIDLF. Operating on top of a closed out solid waste facility is a
violation and must stop. C and D material and burnt vegetative material still onsite atop closed NLCID. More loads of vegetative material were brought atop closed LCID while facility is supposed to be shut down and removing unapproved waste. Roll off with scrap metal onsite as well. Process and remove all waste material.
5. The excavated C and D Waste was still on top of the closed out NLCIDLF. There is an unknown quantity of
smaller pieces of unapproved waste, such as wire, insulation and foam pieces, plastic etc., comingled within the
waste on top of the closed NLCIDLF. Last inspection owners were told, “All waste dumped on top of the closed NLCIDLF must be removed and transported to a permitted landfill for disposal. DO NOT MOVE THIS WASTE TO ANY OTHER PARTS OF THE PROPERTY.” Waste has not been removed.

6. Last inspection owners were told, “on 8/27/2020, C and D loads of brick, painted block, some metal and soil were found stockpiled along the road that leads from entrance toward Interstate. These loads were just past the new building and around the corner near end of road. Once an inspection was done on 9/9/2020, the loads
near the new building were spread out over the ground and blocking the road. These piles of waste must be
removed and disposed of at a permitted landfill. Documentation of proper disposal must be maintained and submitted to Section staff. “Documentation has not been provided to DWM. During this inspection the waste was removed and roadway open. There were also numerous loads of vegetative waste brought in and dumped between this access road and highway and new office building onsite. There was also some concrete brought in and dumped.

7. Vegetative waste, C and D and unapproved waste was dumped in the back of the property, down a side access road. Waste consisted of painted brick and block with tile and other misc. wastes. This site is not approved
for this waste nor dumping in this location either. This waste must be removed and documentation provided to DWM. Cease operating and return site to compliance.
8. Corrective actions consist of: C and D waste needs to be removed to proper permitted facility. This facility is approved to receive YW only after conditions of compliance are complete. CEASE ACCEPTING LOADS UNTIL COMPLIANT. Mr. Gilmore has been instructed to cease accepting waste until all violations are resolved. Do not bring anymore waste on top of the closed NLCIDLF. Remove all waste from the top of the closed

NLCIDLF. Unacceptable waste removed from the closed NLCIDLF and dumped along the road in other areas must be removed and taken to properly permitted landfill. All unacceptable C and D waste should be removed and taken to landfill for that waste type. Documentation for all loads will need to be sent to DWM David Powell for verification they went to the appropriate Landfill. Owners need to make this a priority and complete corrective actions right away.
9. Keep documentation and take pictures. Not much progress has been made on the items mentioned in the inspections but other work continues being done. 10. Last inspection stated, “Due to the failure to meet the conditions of compliance with the NOV and NOCV due dates, the Section will move forward with enforcement which may include civil penalties. Owners were informed by email on 10/28/2020, after inspection, “expect to proceed with further Compliance Action regarding the cleanup of this site.” Please contact me if you have any questions or concerns regarding this inspection report.
