NOTICE OF VIOLATIONS) (citation and explanation):
(1) Permit condition 5(c) of the facility permit states that "waste shall not be stored on the tipping floor after
operating hours." The Henderson County transfer facility was operating in violation of this permit condition in
that waste had been left on the tipping floor overnight.
(2) Permit condition 5(d) states that the "tipping floor and trailer loading area shall be maintained in a sanitary,
clean condition after operating hours in accordance, with the approved operation plan," Section three, page 3-2,
tipping floor operations. The Henderson County transfer facility was operating in violation of this condition in
that the pit area and the.tipping floor were neither cleaned nor washed down.
Henderson County must take immediate steps to ensure that waste is removed from the tipping floor and pit
area on a daily basis and that these areas are washed down following the procedures specified in the facility operational
plan.
A re -inspection of your facility will be conducted to ensure that the transfer facility is following the approved
operational plan and facility permit conditions.
You are hereby advised that, pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $5,000 per day may be assessed for each
violation of the Solid Waste Statute or Regulations. If the violation(s) noted here continue, you may be subject to enforcement actions
including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such
further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

Introduction

L3 Facility Description
The Henderson County Transfer Station consists of a tipping building, tipping building
apron, and access roads. The tipping building will include upper and lower level concrete
slabs with metal wall panels on three sides of the building. The northwest side of the
building will be open for vehicle access to the tipping floor. Two exhaust fans are used
along the southeast wall for odor control and air quality within the operating area. The
tipping building apron and access roads have asphalt and concrete paved surfaces. The
existing scale will be used for weighing incoming vehicles. The outgoing transfer trailer
vehicles will be weighed prior to exiting the facility. A complete set of Civil and
Architectural drawings are included with the permit application and maintained on file at
the facility. The transfer facility is designed to operate as a tipping floor system. Wash
water from the tipping floor and two driveway operations is collected and directed to a
sanitary sewer pump station connected to the City of Hendersonville wastewater
collection system.
The owner of the transfer station is Henderson County; and the county will operate the
transfer station. The primary contact person for issues concerning the operation of the

Solid Waste Screening Procedures
The Henderson County Solid Waste Department routinely screens solid
waste for prohibited materials. Currently, on an average of once per week, a
load of solid waste is thoroughly inspected by having the hauler dump his
load on the transfer station tipping floor. The solid waste is spread out using
the County's Front End Loader and waste inspected by our Solid Waste
Enforcement Officer. The Solid Waste Enforcement Officer and other staff
periodically attend SWANA Conferences for training in the screening of
Solid Waste. In addition the transfer station operator visually inspects all
loads as he operates the transfer station facility and advises our Enforcement
Officer or site supervisor of any questionable material.
Once the loads are inspected, a WASTE SCREENING FORM is completed
and maintain in our State Inspection Log Book located at the Solid Waste
Department offices at the Transfer Station. A. copy of a WASTE
SCREENING FORM is attached.

Henderson County Solid Waste Transfer Facility. There have been no
changes to the operation since issuance of the permit in 1998. At this time
we plan to continue the transfer of solid waste to the Waste Management
Palmetto Landfill. As requested we have revised the contact information
and provided documentation on our waste screening processes.

1. This facility is permitted to receive solid waste as defined in 15A NCAC 13B .0101,
except that hazardous and liquid wastes are prohibited from acceptance at this
facility..
2. This facility may receive solid waste that is generated within the service area
described in Appendix I of this document and shall dispose of said solid waste at
the Waste Management - Palmetto Landfill located near Spartanburg, S.C. or the
BFI CMS Landfill (Permit #13-04) located in Concord, Cabarrus County, North
Carolina.
3. This permit is valid for five (5) years and will be reviewed on or before 1 May 2003,
as per 15A NCAC 13B .0201(e), or sooner according to the issuance date of this
permit. Modifications shall be in accordance with the Rules in effect at the time of
review.
4. This permit is not transferable
5. This permit is for operation of the transfer facility in accordance with the approved
plans and the approved Operational Plan prepared by Camp Dresser & Mckee
(CDM) dated May 29, 1997. Any revisions or modifications to these plans shall be
approved by the North Carolina Solid Waste Section.
6. Operation of the facility shall occur in accordance with 15A NCAC 13B .0402,
"Operational Requirements for Transfer Facilities," the approved operations plan
prepared by CDM and these additional requirements:
a. The owner or operator of a municipal solid waste management facility shall
not knowingly dispose of any type or form of municipal solid waste that is
generated within the boundaries of a unit of local government that by
ordinance:

1. Prohibits generators or collectors of municipal solid waste from
disposing of that type or form of municipal solid waste.
2. Requires generators or collectors of municipal solid waste to recycle
that type or form municipal solid waste.
b. This facility shall be operated in a manner which is consistent with the State
solid waste management plan and with the solid waste management plans
that have been adopted by those units of local government served by the
facility and approved by the Section..
C. Waste shall not be stored on the "tipping floor" after operating hours. Waste
can be stored in transfer trailers, at the facility with covers in place, after
operating hours, but no longer than 48 hours.
d. The tipping floor and transfer trailer loading area shall be maintained in a
sanitary, clean condition after operating hours in accordance with the
approved Operational Plan prepared by CDM, consistent with Section Three,
page 3-2, Tipping Floor Operations.
e. On or before 1 August (or at an earlier date as requested by the Division) of
each year, the owner or operator shall report to the NC Solid Waste Section,
for the previous year beginning 1 July and ending 30 June, the amount by
weight of the solid waste that was received at the facility and disposed of in
a landfill, incinerated, or converted to fuel. To the maximum extent
practicable, such reports shall indicate by weight the COUNTY of origin of all
solid waste. The owner or operator shall transmit a copy of the report to the
county in which the facility is located and to each county in which waste
originated.
A random waste inspection and screening program shall be conducted a the
transfer facility. Frequency of screening and method of recordation shall be
approved by the Solid Waste Section.
