Dear Mr. Smith:

On Tuesday, April 7, 2020 Jeffrey Bullard, representing the State of North Carolina, Division of
Waste Management Solid Waste Section, inspected the above referenced facility for compliance
with North Carolina solid waste statutes and rules. The following violation(s) were noted:

A. 15A NCAC 13B .0842 (a)(1) only domestic septage, as defined in G.S. 130A-290,
shall be land applied or otherwise placed on a septage land application site, unless
specified in the permit;

• Violations of the above stated rule were observed on fields 3 and 4, where wastewater
treatment plant sludge was applied to the permitted septage land application site.

B. 15A NCAC 13B .0842(a)(17) approved nutrient management plans shall be
followed;

• Violations of the above stated rule exist in the failure to maintain a crop as described by
the Nutrient Management Plan. No evidence of winter crop overseeding or weed control
was apparent on any field.

Based upon the foregoing, Atlantic Sewage Control shall come into compliance by June 18, 2020
with all requirements of the regulations in 15A NCAC 13B .0842: (a)(1) and (a)(12) by completing
the following:

1.Immediately ensure that only domestic septage, as defined in G.S. 130A-290, is land
applied or otherwise placed the permitted septage land application sites.
2.Submit a plan of action detailing the steps that will be taken to ensure that septage will
only be applied to fields with adequate crop coverage and that the spring and summer
crop requirements of the NMP and permit will be met.
3.Immediately route unnecessary traffic off of or around buffer areas and permitted field
surfaces.
4.As required by the NOV issued for this site on November 18, 2019, establish and maintain
50-foot buffers along the southeastern boundary of field 4 as specified in the Soil Erosion
and Runoff Control Plan section of the Nutrient Management Plan.
Atlantic Sewage Control shall provide a written certification with supporting documentation on
company letterhead confirming the noted compliance schedule has been completed. Include in
this certification any actions taken to prevent these violations from occurring in the future.

The violation(s) listed above were observed by Section staff and require action on behalf of the
facility in order to come into or maintain compliance with the Statutes, Rules, and/or other
regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22,
an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid
Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the
N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management
facility or a solid waste collection service and any such further relief as may be necessary to
achieve compliance with the North Carolina Solid Waste Management Act and Rules.
