OBSERVED VIOLATIONS: During the site visit on 4/07/20 violations of the following rules were observed. A. 15A NCAC 13B .0842(a)(1) only domestic septage, as defined in G.S. 130A-290, shall be land applied or otherwise placed on a septage land application site, unless specified in the permit; B. 15A NCAC 13B .0842(a)(17) approved nutrient management plans shall be followed; The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 3 ADDITIONAL COMMENTS 1) An appropriate septage land application sign was present at the entrance to the site. 2) Access roads were passable 3) Some field markers were run over or missing. Any field markers knocked down or out of place need to be replaced. 4) No recent discharges were observed outside of the permitted field boundaries. 5) (See item A in the Observed Violations section) A Notice Of Violation was issued for land applying non-septage materials consisting of wastewater treatment plant sludge (WAS) onto the permitted septage land application site fields 3 and 4. Wastewater treatment plant sludge was observed applied to large areas of fields 3 and 4. An employee of Atlantic Sewage Control present at the time of the inspection when asked, indicated that the sludge came from the Elizabeth City WWTP. 6) (See item B in the Observed Violations section). A Notice Of Violation was issued for failure to maintain a crop as described by the NMP. No evidence of winter crop overseeding was observed on any field. The vegetation on Fields 1,2 and 4 was predominantly weeds. Soil surfaces in areas of some fields were impacted by past applications of lime mud and heavy traffic resulting in poor crop stands and bare soil. All fields require weed control. Traffic across the southern portion of the field 4 buffer and areas bordering the road has destroyed vegetation and compacted soil surfaces. Lime mud and traffic impacted areas need the crop restored. Vehicular traffic on the permitted areas should be minimized to what is necessary for land application of septage and maintenance of the crop. The emerging summer crop (Bermuda) was diminished or not present in many of the impacted areas described above. 7) pH was not checked 8) No objectionable odors noticed. 9) Setbacks not checked. 10) A copy of septage land application records where not checked.
